Developer Rights and Equalization

The current Territorial Governance Plan (PGT) provides for the recognition of building rights and their transfer from areas of indirect relevance to areas of direct relevance, with the equalization technique, as well as the transfer of building rights linked to the various forms of incentives provided by the same PGT for other specific cases.

Contracts that transfer, constitute or modify development rights are recorded in the Register of transfers of development rights (art. 11 of LR 12/2005 and subsequent amendments).

Given the multiplicity of cases of transfer of development rights envisaged by the acts of the PGT in force, with the Municipal Council Resolution n. 890 of 10/05/2013 , Managerial Resolution no. 29 of 18/07/2013, the operational criteria and guidelines for the correct formation and management of development rights have been identified and explained, as well as the structure and management of the Register, the methods for requesting and the related annotation in the Register itself of the areas and development rights generated , as well as the methods for issuing the relevant certificate.

The Transfer Register is made public in digital form in compliance with privacy regulations.

Personal data, understood as information referring exclusively to natural persons, identified or identifiable, collected with the requests for annotation in the Register of Development Rights or in any case acquired for this purpose, are not subject to dissemination and/or communication to third parties, unless such operations are necessary to implement legal or regulatory provisions.

Information relating to subjects other than natural persons may also be communicated and/or disseminated through the Municipality of Milan website.

Types of Annotation Requests

  • request for registration of the Development Rights in the Transfer Register and release of the relevant certificate following the free transfer of the indirectly relevant areas as identified in the S.02 series Tables of the Service Plan of the current PGT;
  • request for registration of Development Rights in the Transfer Register and release of the relevant certificate following the purchase of all or part of the development rights relating to Certificates already issued;
  • request for registration of (residual) Development Rights in the Transfer Register and release of the relevant certificate following the partial sale of development rights relating to Certificates already owned by the applicant and transferred to third parties.

Furthermore, it is possible to request the waiver of the registration of the Development Rights in the Transfer Register and the release of the relevant certificate for the free transfer of indirectly relevant areas, in the event of sale of the area before the conclusion of the transfer procedure or of another motivation.
