Certificate of Urban Destination - CDU

The Urban Planning Destination Certificate (CDU) is a document required by art. 30 of Presidential Decree n. 380 of 6/06/2001 "Consolidated text of legislative and regulatory provisions on construction" containing the urban planning requirements regarding land, as defined by municipal planning instruments.

The UCC is necessary for the stipulation of deeds concerning the transfer, establishment or dissolution of the communion of real rights relating to land, as well as to land that constitute appurtenances of buildings registered in the new urban building register, provided that the overall surface area of ​​the pertinent area the same is greater than 5.000 square meters.

In the case of requests for urban planning certificates/certificates/declarations, provided for by other rules and provisions of current laws, it is necessary to specify the type and the relevant reference legislation.

There are no emergency procedures for issuing the certificate.
It is advisable to submit requests well in advance of the date of use.

The times foreseen by the art. 30 of Presidential Decree 380/2001 for the issue of the certificate are 30 days, after which it can be replaced by a declaration from the seller or one of the sharing parties certifying the submission of the application, as well as the urban destination of the land according to the current or adopted urban planning instruments, or the non-existence of these, or the prescription, by the approved general urban planning instrument, of implementing instruments (art. 30 paragraph 4 of Presidential Decree 380/2001).

The CDU is valid for one year from the date of issue if no changes have occurred to the urban planning instruments (art. 30 paragraph 3 of Presidential Decree 380/2001).
 

  • secretarial fees equal to €100,00 (DGC n. 706 of 18/05/2022);
  • two revenue stamps of €16,00 each, one for the application and one for the issue.

Payments must be made via the PagoPA circuit and are considered fulfilled only if there is a match between the imprint of the certificate request and the imprint of the payment receipts which must both show the same case ID.

If the applicant is exempt from paying the stamps, in order to benefit from the exemption, he must expressly declare in the Request Form the legal details to which he refers.

In the event of issuing certificates not budgeted for compared to the one requested, it is necessary to pay the secretarial fee, equal to €100,00, for each additional certificate, as an adjustment to the fees already paid.

The online form, duly completed, must be accompanied by the following documentation:

  • legible photocopy of the applicant's identity document or, in the case of requests presented by a person in charge/delegate, a copy of the task/delegation accompanied by a photocopy of the relevant identity documents (ownership and person in charge/delegate);
  • extract of the cadastral map (land register) at 1:1.000 scale issued by the Land Agency-Office of Milan on a date no earlier than three months, with the area covered by the request highlighted by a red outline. The map extract must be clearly legible (map numbering and related perimeters).

Special cases

In the event that the areas covered by the request are affected by subdivisions not yet included in the cadastral map, a copy of the subdivision approved by the Land Agency must be produced.

In the case of using a map extract issued more than three months ago, or a related photocopy, and the same does not differ from the cadastral map, it is necessary to include on this map the following declaration, with date and signature: "It is declared that this excerpt of the map conforms to the original deposited at the Land Agency-Office of Milan". 

Map extracts, or photocopies thereof, with a date greater than one year from the date of use cannot in any case be considered valid for the purposes of the request.
