OUTCOME:

The Central Procurement Manager of the Marche Region illustrated the regulations on procurement based on the "Genoa model", going into the merits of the procedures: preliminary market consultation, awarding of works, simplifications in procedures, reduction of timescales for expropriations and authorizations for environmental protection . The Single Central Procurement Director reported on the exceptions to the procurement code, useful for speeding up tender procedures in school construction. You highlighted the fact that by decree law the mayor has been given commissionerial powers for school construction. During the debate, the need to implement a monitoring and profiling system for contracting companies in the preliminary phase was raised, as well as the opportunity to guarantee adequate training of public administration personnel who carry out their activities in the field of public procurement and works. The Councilors requested information and obtained comprehensive answers regarding SOA certifications, integrated procurement, company ratings and the changes to be made to the procurement code.

Agenda: Resolution no. 208: "Recognition of an off-balance sheet debt pursuant to art. 194, 1st paragraph, letter a), Legislative Decree 267/2000 for the amount of €29.954,97 due for the reimbursement of the construction contribution paid in excess by California Srl, including legal and default interests, as well as court costs, in compliance with the injunction decree no. 1177/2019 of the Lombardy TAR." The regional leaders of INAIL illustrated the regulatory framework of reference for Covd-19 cases and outlined its operational aspects. Furthermore, the institution of the "Simple presumption" was described, useful for the recognition of any compensation or compensation, in extreme cases. Requests were made to them for clarification on the number of cases that occurred in the city (data not yet available) and on the methods of recognition of compensation, in the case of services provided to multiple employers and for self-employed workers. Finally, it was specified that, during the health emergency, the number of traditional commuting accidents (to and from the workplace or during working hours) was considerably reduced and that the categories most affected by infection are healthcare, welfare, sales workers, transport workers, post office workers, pharmaceutical and IT sectors.

SPECIALIST COLLECTIONS AND COLLECTIONS DIRECTORATE Resolution N/210 - Recognition of off-balance sheet debts pursuant to art. 194 paragraph 1 letter a) of the Consolidated Law on Local Authorities (TUEL), deriving from the payment of legal expenses for executive judicial measures unfavorable to the Municipality of Milan in cases falling within the competence of the Specialized Collection and Collection Directorate for a total of €61.194,12, relating to judicial measures relating to the area of ​​compulsory collection and sanctions of the Highway Code. The measure involves expense. They will be present:

OUTCOME:

The session to illustrate the two resolutions on the agenda took place in the presence of the Councilor for Budget and State Property, as well as the top managers of the Budget and Participates Department. The first concerns the change regarding the adjustment of related appropriations, between different spending programs, in order to adapt the capacity for economic commitment, due to the state transfers referred to in the so-called «Cura Italia» Decree linked to the COVID emergency, with contextual allocation of the amounts to expenditure. In particular, the revenue and expenditure allocations are adjusted as regards the "Mutual Aid Fund" initiative. The second concerns the recognition of off-balance sheet debts deriving from the payment of legal expenses for legal measures unfavorable to the Municipality of Milan. The councilors present took note of the financial consequences of the measures adopted.

Resolution no. 206 "Recognition of off-balance sheet debts, pursuant to art. 194 paragraph 1, letter A) of Legislative Decree 267/2000, deriving from the payment of legal expenses for 49 unfavorable executive judicial orders issued by the judicial authority against the Municipality of Milan in appeals against violations ascertained by the Local Police for a total of €23.640,57. The Deputy Mayor-Security Councilor, Anna Scavuzzo, will be present at the session.

OUTCOME:

The Deputy Mayor, with the help of the Deputy Commander of the Municipal Police, illustrated the proposed resolution no. 203 and 206, relating to off-balance sheet debts, deriving from the payment of legal expenses for unfavorable executive judicial measures issued by the judicial authority, towards the Municipality of Milan, in appeals against violations ascertained by the Local Police. They are essentially due to material errors made by the inspector of the fine or to the age-old question linked to the doubt whether or not traffic officials can also impose fines on cars parked on yellow lines. After a brief debate, the two measures have been discussed and can be submitted to the City Council.
