Starting from the year 2021, the General Secretariat of the Municipality of Milan publishes in this section some circulars and information notes which, given their content, may also be of possible interest to an external public.

    The Circular reports the provisions aimed at allowing the correct identification of the so-called beneficial owner, pursuant to and for the purposes of article 20 of Legislative Decree 21 November 2007, n. 23.

    The circular illustrates the contents of the resolution adopted by the Court of Auditors - Regional Control Section for Emilia Romagna, in the Plenary Meeting of 21 February 2024, reporting the rules in force for the assignment of consultancy assignments by Local Authorities and , more generally by the PA, taking up previous interventions by the accounting judiciary on the subject.

    The circular illustrates the contents of resolution 528 of ANAC which, in interpreting the provisions of the art. 41 paragraph 14 of Legislative Decree 36/2013, considered that "the cost of labour, although quantified and indicated separately in the tender documents, is included in the overall tender amount, on which to apply the discount offered by the competitor to define the contractual amount.”

    The circular highlights the most relevant contents of opinions 57 and 57 bis of 15/11/2023 of ANAC which specifies that, based on current legislation pursuant to art. 17 paragraph 5 of Legislative Decree 36/2023, "the award is arranged by the contracting authority after having positively checked the requirements of the successful tenderer, after which the contract can be stipulated or its execution can begin urgently"

    The circular contains a summary illustration of the main measures provided for by Legislative Decree no. 131/2023 on energy, interventions to support purchasing power and to protect savings as well as the extensions of regulatory deadlines and tax payments provided for by Legislative Decree no. 132/2023, both published in the Official Journal no. 228 of 29 September 2023.

    With this circular, the Municipal Directorates are informed of the contents of the memorandum of understanding stipulated on 28 June 2023 with the Guardia di Finanza of Milan whose purpose is the protection of the resources of the PNRR and the PNC and of the programs co-financed by the EU structural funds .

  • Circular no. 15 of 21 December 2022 (pdf - 326.131 KB)
    The Circular, due to the recent approval by the ANAC of the 2022 National Anti-Corruption Plan (PNA), highlights, by providing consequent operational indications to the offices, what is now the most extensive compendium of data and documents to be published in Transparent Administration, in particular in the subsection Calls for tenders and contracts, as pertaining to each type of contract and each phase, from planning to the choice of the contractor, from the award to the execution of the contract, as promptly reported in Annex 9 of the aforementioned PNA.

    The Circular, taking inspiration from a recent decision of the Campania Regional Administrative Court, addresses the issue, already the subject of specific decisions of the Council of State, of the possible reiteration of requests to the Public Administration, even where definitive decisions have been made; to this end, the principle is reaffirmed according to which such requests, where they can in fact be qualified as soliciting a "self-defense" procedure, do not imply a legal obligation to take action on the part of the Administration itself, which has a wide margin of discretion in this sense.

    The Circular intends to emphasize the fact that, in implementation of article 81, paragraph 2, of the legislative decree of 18/4/2016, n. 50, starting from 9 November, to participate in tenders, it will be mandatory to use the Virtual File of the Economic Operator - operational in the Anac database - which allows contracting authorities, through a specific web interface, to verify the requirements for participation in public procurement.

    The circular briefly illustrates the main innovations introduced by Law no. 142 of 21 September 2022 converting Legislative Decree no. 115 of 9 August 2022 containing "Urgent measures regarding energy, water emergency, social and industrial policies".

    The circular highlights the recent ANAC Guidelines regarding the implementation - even in progressive phases - of the qualification system of contracting authorities and central purchasing bodies. These are indications regarding the requirements necessary for the qualification of contracting authorities and purchasing centers, the information necessary to demonstrate possession of the same, the methods for collecting such information and for the functioning of the system, which will be applied once the decrees containing the new regulations for public contracts were approved.
  • Circular no. 10 of 13 September 2022 (pdf - 516.523 KB)
    The circular, in commenting on the recent pronouncement of the Council of State section. VI, n. 05746 of 8 July 2022, highlights that silent consent is also formed when the private individual's request does not comply with the rules. This clarification is all the more significant as it also refers to the procedure for issuing the building permit pursuant to art. 20 paragraph 8 Presidential Decree 380/2001.

    The circular, concerning the procedure for recognizing off-balance sheet debts, is aimed at integrating the contents of the previous circular from the General Secretariat, issued on the same topic on 16 June 2020 (which is merged for completeness). This document addresses specific issues such as times and methods of presentation of the resolution proposal, the criteria to be followed in the event of a possible settlement agreement with the counterparty, the method of dealing with the charges deriving from any writs of injunction and/or seizure, the criteria to be follow in case of recognition of debt arising from the art. 194 paragraph 1 letter e) of Legislative Decree 267/2000.

    The circular following the Anac resolution n. 469 of 09 June 2021, contains the description of the most relevant aspects regarding the scope of application, the type of whistleblowing reports, the measures to protect the identity of the whistleblower.
  • Circular no. 4 of 5 October 2021 (pdf - 825.129 KB)
    The circular illustrates the resolution of the National Anti-Corruption Authority n. 468 of 2021 regarding: "obligations to publish documents granting grants, contributions, subsidies and attribution of economic advantages to natural persons and public and private bodies (articles 26 and 27 of Legislative Decree no. 33/2013) ”, reporting some cases of interest for the administrative activity of the organisation.

    From the date of convocation of the electoral rallies and until the conclusion of the voting operations, "all public administrations are prohibited from carrying out communication activities, with the exception of those carried out in an impersonal and indispensable form for the effective performance of their functions" (art. 9 Law 28/2000) In its Circular No. 3/21, the General Secretariat briefly recalls the provisions on the regulation of institutional communication and equal access to the media as well as on the obligations regarding electoral propaganda.

    Pursuant to art. 38, paragraph 5 of Legislative Decree 267/2000, the municipal councils remain in office for a period of five years until the election of the new ones, limiting themselves, after the publication of the decree calling the electoral rallies, to adopting the urgent acts and cannot be postponed. From an operational point of view, Circular no. 2/21 of the General Secretariat proposes a reflection aimed at establishing what the acts with the requirement of non-deferrability and urgency may actually be, given that the law does not specifically list them.
  • Beneficial Owner Circular (pdf - 902.863 KB)
    It is mandatory for private entities who conclude use concession contracts or urban planning agreements with the Administration or who are recipients of a loan, a contribution, or economic advantages of any kind, or of authorization and/or concession provisions, to communicate the beneficial owner, as defined by Legislative Decree 21 November 2007, n. 231 and subsequent amendments. In this circular, the General Secretariat illustrates the provisions in this sense included in the three-year corruption prevention and transparency plan 2021-2023.
