DISCIPLINARY CODE

The art. 55 of the Legislative Decree. 30.03.2001 n.165/2001 establishes that “The publication on the institutional website of the administration of the disciplinary code, indicating the infringements and related sanctions, is equivalent in all respects to its posting at the entrance to the place of work”.

On 16 November 2022, the new National Collective Labor Agreement 2019-2021 for non-managerial staff of the LOCAL FUNCTIONS sector (CCNL 2019-2021) was signed, which establishes that the disciplinary code must be given maximum publicity through publication on the website institution of the institution.

The new Disciplinary Code, contained in the art., is therefore published here. 72 of the 2019-2021 CCNL (which replaces art. 57 of the 2016-2018 CCNL), together with the employee's obligations contained in art. 71 of the 2019-2021 CCNL (which replaces art. 59 of the 2016-2018 CCNL ).

The art. 58 "Disciplinary sanctions" of the 2016-2018 CCNL has not been modified by the 2019-2021 collective agreement and therefore remains in force.

The new disciplinary code will come into force on 8 December 2022.

Furthermore, it is considered appropriate to maintain the online publication of the rules relating to the types of disciplinary offenses introduced over the years in Legislative Decree no. 165/2001, and the disciplinary code of the 2016-2018 CCNL which remains in force until the date of entry into force of the new disciplinary code and for events occurring before that date.

Furthermore, the provisions relating to the procedures envisaged for the application of disciplinary sanctions are reported.

CODES OF CONDUCT

Law 190/2012 "Provisions for the prevention and repression of corruption and illegality in public administration" intervened, among other things, in the field of codes of conduct for public employees, requiring the Government to issue a new Code of Conduct in order to ensure the quality of services, the prevention of corruption, compliance with the constitutional duties of diligence, loyalty, impartiality and exclusive service to the care of the public interest

With Presidential Decree n.62 of 16.4.2013, the Code of Conduct for public employees was therefore issued and amended by Presidential Decree of 13 June 2023, n. 81. The new Code is in force from 14.07.2023.

Law 190/2012 has also reformulated art.54 of Legislative Decree. 165/2001, providing that the Public Administrations adopt an administrative code of conduct which integrates and specifies the discipline contained in the Code of Conduct for public employees issued with Presidential Decree 62/2013.

The Code of Conduct for the Administration of the Municipality of Milan came into force on 25.11.2021 and was approved with City Council Resolution no. 1369 of 05.11.2021 following a procedure open to participation and acquisition of the favorable opinion of the Independent Evaluation Team.
