The House approves the resolution on the expansion of the occupation of public land for commercial activities

Milan, May 15 2020 - With 41 favorable opinions and one against, the City Council last night approved the expansion of temporary public land occupations connected to food and drink supply activities and other commercial activities. A provision that allows operators to increase their occupancy spaces, thus ensuring compliance with the provisions on distancing and limited entry necessary to prevent the spread of Covid-19.

The text approved by the Chamber provides for the implementation of a special and transitional regulation, in force until 31 October, which makes the authorization process quicker and simpler for businesses wishing to request the occupation of land on squares, streets, green areas, sidewalks, parking areas and pedestrian areas.

In particular, requests for the installation of tables, umbrellas, platforms and similar removable temporary structures connected to the exercise of the activity of serving food and drinks in bars, restaurants, entertainment venues and the like, as well as other commercial activities , can be submitted electronically and will be instructed and authorized by the municipal administration within 15 days.

Consistent with the provisions of the Decree of the Council of Ministers of 13 May, the payment for land occupation (COSAP) will be suspended until 31 October both for operators who request the installation of temporary structures and for those who have permanent outdoor areas. The latter will also be exempt from payment for the months of March, April and May and on an extraordinary basis will be able to pay the 2020 fee in 3 installments which will be issued with deadlines 15 October - 15 November - 15 December 2020 or, for amounts not subject to installments, in a single payment upon expiry of November 15th.

To encourage the development of projects in areas where there are multiple commercial activities that require space, the Administration may provide temporary pedestrianization and allow the placement of tables even not close to the commercial establishment. The assignment of new spaces must take into account both existing concessions that require expansion and new requests, maintaining a balanced relationship. The occupations must in any case guarantee the regular transit of safety and rescue vehicles, a passage for pedestrians of at least 2 meters wide and the mobility and passage of people with motor disabilities and their companions.

The Administration will carry out specific monitoring and controls to verify compliance with the authorizations issued and will convene specific Service conferences which involve the participation and collaboration of the municipalities.

In relation to the authorization for the installation of temporary structures, the current regulatory provisions regarding the occupation of public land, green areas, municipalities are therefore suspended until at least 31 October, without prejudice to a subsequent provision by the City Council for a further extension in relation to the health emergency. , street furniture, connected sub-services. However, all the provisions in force in the field of safety and public safety relating to road safety, public order, the containment of noise pollution and the ban on gatherings remain firm and mandatory, as well as the rules for the normal conduct of separate waste collection.
