Transfers of non-pertinent boxes can take place in favor of:

• natural persons resident in Milan or companies with headquarters in Milan
• “operators” in Milan (operators are those who continuously carry out their activity in the city area)
• owners (even if not resident in Milan) of properties located in Milan.

Based on the provisions contained in Management Resolution no. 15 of 14/02/2019, for the purposes of transferring the box it is sufficient to send a communication to the Municipality. 

The competent municipal office, after receiving the "Communication", will not issue any provision, applying the institution of silent consent for this procedure. The municipal administration has 30 days from the presentation of the communication to issue any "prohibition on transfer" measures, if the lack of requirements for the future owner of the surface right or right of use has been found.

How to present the Communication
Please send your documentation using the channels below. In all cases it is necessary to attach the documents indicated at the bottom of the form.

The current assignee of the right (of surface or use) of an appurtenant box can transfer the "right" to another person, provided that the latter is the owner of a property to which he will transfer the constraint of appurtenance of the same box.

Transfers of the appurtenant garages can take place in favor of property owners provided that the property owned is located in "proximity" to the garage. The distance from the property must be such as to allow the establishment of a "service relationship" between the car park and the main property. The request for transfer can be presented if one of the following cases occurs:

1. transfer of the pertinent restriction of the garage/parking space to another real estate unit and simultaneous transfer of the right (of surface/use) of the garage/parking space to another party (e.g.: Mr. Rossi sells the garage to Mr. Bianchi and the relevance of the garage has moved from Mr. Rossi's property to Mr. Bianchi's property)
2. transfer of the pertinent restriction of the garage/parking space to another real estate unit of the same owner of the (surface/use) right of the garage/parking space (e.g.: Mr. Rossi transfers the pertinence of the garage from one property to another owned by him).

Transfer of the garage with the apartment
In the event that the appurtenant garage is transferred together with the property to which it is linked with appurtenant restrictions, it is not necessary to request authorization from the Municipality.

As regards the transfer of said box, reference will therefore be made to the procedure which provides for the simple "Communication" of the transfer of the surface right to another party.

In this case, for the sake of completeness of the investigation, we ask you to send a copy of the preliminary sales document relating to the transfer of the property and garage.

How to submit the application
The authorization request must be formulated by the owner of the surface right/right of use using exclusively the form provided below and presented with the affixing of a 16,00 euro tax stamp. The second revenue stamp must be kept and affixed to the Authorization which will be sent in digital format (to be printed and delivered to the Notary).

The competent municipal office, after having received the request and verified its completeness, will issue the authorization provision within a maximum of 30 days from the date of registration of the request.
