SPV – Early removal of conventional constraints on subsidized residential construction 

The conventional constraints relating to the maximum transfer price and the subjective requirements of the assignees of the housing units, and their appurtenances, can be removed before the expiry of the Agreement, if they fall within the categories specified below and upon payment of a fee and subsequent signing of a notarial deed.

The application must be submitted by completing the appropriate form, accompanied by all the required documentation, by sending it to the following email address:

With reference to DCC n°35 of 28/04/2021, the owners of the accommodation and related appurtenances, which fall into the following types of subsidized buildings, can request early removal:

  1. Residential buildings for sale (ordinary and subsidized agreements), built on private areas and affiliated with the Municipality pursuant to art. 18 of Presidential Decree 380/2001 for maximum sales price and subjective requirements of the assignees, if 5 years have passed from the date of the first transfer of the property, unless otherwise provided for in the stipulated urban planning agreement.

    NB properties intended for rental only are excluded from the procedure.
    The release fee will be calculated in accordance with DCC 42/2010 with the methods already established in City Council Resolution 20 of 15 July 2015
     
  2. Public housing (PEEP) referred to in the art. 31 paragraph 45 of L.448/98, built on areas owned by the municipality, transferred under ownership or surface rights and agreed with the Municipality, pursuant to art. 35 of L.865/71 or art. 8 of L.10/77 for maximum sales price/rent and subjective requirements of the assignees, at least 5 years have passed from the date of the first transfer of ownership of the real estate unit, in the following ways:
  • for surface right agreements, simultaneously with the act of transformation of the surface right into property right.
  • for agreements in property law, with deed of release.

The release fee will be calculated according to the criterion referred to in Law 448/98 – art. 31 paragraph 49 bis, and as explained in the implementing decree of the Ministry of Economy and Finance DM 151 of 28/09/2020.
