Degraded-abandoned-disused buildings

Il Territorial Government Plan Milan 2030 in table R.10 "Land consumption map" identifies abandoned and degraded buildings, disused for at least one year before their identification, which cause danger to safety or health and public safety or inconvenience to urban decorum and quality, regulated by art. 11 of the Implementation Rules of the Rules Plan.

The property is given the right to initiate, within 18 months of identification, the works aimed at recovering your property or demolishing it, so as to safeguard existing regularly approved surfaces (existing SL). Once the deadline has elapsed, in the absence of the start of work by the property, the area is only recognized as having a single territorial building index equal to 0,35 mXNUMX/mXNUMX.

Following the City Council Resolution n. 108 of 20/12/2021, part of the abandoned and degraded buildings present in table R.10 "Land consumption map" were deemed identifiable as abandoned building heritage with critical issues pursuant to art. 40 bis of LR n. 12/2005 and, therefore, with Managerial Resolution no. 5376 of 05/07/2022 the aforementioned PGT cartographic document has been consistently updated with respect to the contents of the council act.

Table R.10 and the identification of the abandoned building heritage with critical issues pursuant to art. 40 bis are subject to periodic updates.

Forwarding reports of abandoned buildings with critical issues

The owner or person entitled has, at any time, the possibility of forwarding, via PEC, the report of the property (ref. art. 40 bis of Regional Law 12/2005).

Required documents:

sworn expert opinion which certifies the non-use of the property since at least June 2020 and one or more of the aspects that cause critical issues (health, hydraulic safety, structural problems that compromise its safety, pollution, environmental, urban-building and social degradation), through documentary evidence and also photographic;
declaration in lieu of the deed of notoriety by the owner or legal representative reporting the date of complete disposal of the property.

Minimum contents for submitting the report >>>

In 60 days from receipt of the report, without prejudice to any requests for integration, the outcome of the verification of the existence of the conditions will be communicated. In the event of no response, the verification of the appraisal is considered to be completed with a positive outcome.
The properties deemed suitable will be included in the list following the adoption by the municipal council of a resolution updated every six months.

In the case of the owner or holder of title deemed necessary review the identification of your property in table R.10 “Land Consumption Map” it is possible to send, via PEC, a request for modification duly documented also with photographs demonstrating:

failure to dispose of the entire property;
the lack of critical issues that pose dangers to urban health and safety, situations of environmental and social degradation.

It is possible to report the presence of abandoned and degraded buildings by sending, via
e-mail, an instance in which at least the following specifications are inserted:

full address
presence of one or more critical issues that pose a danger to urban health and safety, situations of environmental and social degradation
also indicative decommissioning period
photographs taken from outside
