Ordinary landscape authorization

The landscaping permit is a mandatory administrative measure for all building interventions in areas subject to landscape protection restrictions.

It constitutes an autonomous act and is prerequisite to the building permit or other building permit.

When to request it

The owners, possessors or holders in any capacity of properties and areas of landscape interest, protected by law, have the obligation to present the project of the interventions they intend to undertake, accompanied by the required documentation, refraining from starting the works until they have obtained express authorization. In fact, they cannot destroy them or introduce modifications that would prejudice the landscape values that are the object of protection (ref. Legislative Decree 42/04, art. 142, 136, 143, 157).
However, the landscape authorization is not required for:

“ordinary and extraordinary maintenance, static consolidation and conservative restoration interventions that do not alter the state of the places and the external appearance of the buildings” (Legislative Decree 42/04, art. 149);
the interventions indicated in Annex "A" to Presidential Decree 31/2017.
