Activate a social offering unit: Preventive Operational Communication

The managing bodies that intend to activate, in the territory of the Municipality of Milan, a structure belonging to the Social Network must present the Municipal Administration with the Preventive Operational Communication (CPE).

The CPE is the indispensable act for the exercise of the offering unit which, at the same time, starts the control and supervision activity.
The Preventive Exercise Communication, therefore:

  • enables the managing body to immediately undertake the activity of the offering unit
  • it also involves a direct and exclusive responsibility of the manager of the same offering unit, as well as the inevitable consequences on an administrative level
  • replaces the Operation Authorization for all intents and purposes
  • does not require any formal act of authorization or consent from the Municipality of Milan, either in the presentation phase or following receipt of the supervisory report certifying possession of the minimum operating requirements.

The Social Offer Units (UdOS) currently present in the Social Network are:

CPE is used in the following cases:

  • commissioning of offering units, to be understood as the preparation of all the organisational, managerial and structural measures necessary to start the activity
  • change in the accommodation capacity of the offering unit, to be understood as an increase or reduction in the capacity to accommodate or provide services or services
  • transformation of existing offering units, to be understood as a modification of the type of offering unit among those identified by the Region
  • transfer of existing offering units to another location, to be understood as a change to the location where the activity is carried out, even when this occurs within the same building or the same municipality and regardless of the registered office of the managing body
  • change of managing entity, also as a result of events terminating the previous one: in the case of private legal entities it may be the case of dissolution, merger by incorporation or through the establishment of a new entity. In the case of public bodies, it may be a matter of succession between bodies, also as a result of changes to the reference regulatory framework. In the case of third sector entities, it may also involve changes to the statute that affect the social objectives.

For the presentation of the CPE, the Manager must comply with the provisions of current regional legislation.

The procedure for setting up a Social Offering Unit (UdOS) is as follows:

  • presentation of the CPE
  • verification, by the Territorial Services Monitoring and Control Unit, of the completeness of the communication and of what was self-declared, in relation to the requirements possessed, as well as the presence of the certificates relating to the subjective requirements, within 30 working days
  • request from the Municipality to the Milan ATS, after the checks indicated, for the supervisory visit to be carried out within 60 days from the date of receipt of the request
  • within 75 days of the Municipality's request, feedback from the Milan ATS to both the Municipality and the manager in relation to the supervisory activity.

After commissioning, through presentation of the CPE, the managing body must promptly and formally notify the Municipality in the event of:

  • modification of the person of the legal representative of the managing body, communicating the data of the new legal representative and attaching the substitute declarations relating to the subjective requirements
  • modification of the data of the managing body (change in the registered office, name, legal form and any other modification that does not lead to the creation of a new legal entity and consequent attribution of a new tax code)
  • structural changes that do not involve the presentation of a new CPE
  • cessation of the activity, with indication of the date of actual cessation.

NB: The video tutorial does not illustrate the payment of charges established by City Council Resolution no. 1250/2023 in case of presentation of CPE starting from 15/01/2024. The video is being updated.

The CPE must be submitted electronically using the platform Impresainungiorno.gov.it.

During the compilation you will be asked: 

  • the payment of the charges foreseen by the Municipal Council Resolution 1250/2023 in case of presentation of the Prior Exercise Communication. The payment will be made within the Impresainungiorno portal, through the PagoPA payment system
  • digital signature of the legal representative or attorney for signing the practice
  • PDF file of the identity document of the legal representative and attorney (if present), digitally signed
  • PDF file of the floor plan of the rooms used (maximum size 9,77MB), digitally signed. 1:100 scale plan of all the rooms used (including the basement where present), updated to the actual state, quoted and oriented with stamp and signature of the applicant and the technical editor, dated, legible, including cross section (quoted and oriented), including: 
    • table broken down for the individual rooms indicating for each: intended use, height, surface area, ventilation and lighting ratios calculated analytically and separately 
    • highlight the access route to the structure in relation to the removal of architectural barriers (where provided)
    • in the case of a "plex" with multiple social activities, highlight with appropriate screening any rooms in common use between the various areas (for example: entrances, kitchen, closet, pantry, changing rooms and bathrooms)
    • for childcare services, report the calculation of the surface area/child ratio as per the reference legislation.
