Privacy information SANCTION PROCEDURES

Information pursuant to art. 13 of EU Regulation no. 2016/679

Pursuant to art. 13 and 14 of EU Regulation no. 2016/679 (General Regulation on the Protection of Personal Data), the following information is provided.

1. Data controller

The data controller is the Municipality of Milan, Urban Security/Local Police Directorate: PL.Privacy@comune.milano.it 

2. Personal data protection officer

The Data Protection Officer - “DPO”) of the Municipality of Milan can be reached at the following e-mail address: dpo@comune.milano.it 

3. Types of data processed

The completion of the sanctioning procedure involves the processing of personal data, as well as, possibly, particular data.

4. Purpose and legal basis

The processing of personal and particular data is aimed at carrying out activities connected and instrumental to the completion of the sanctioning procedure, pursuant to articles. 6 (paragraph 1, letter e), 9 (paragraph 2 letter g) of EU Regulation 2016/679, as well as, by way of example, Law no. 65/86, Law of the Lombardy Region no. 6/2015 , of the Code of Criminal Procedure, of Law n.689/81 and of Legislative Decree n.285/92 (Highway Code).

5. Processing methods

The processing takes place in compliance with fundamental rights and freedoms and is based on the principles of correctness, lawfulness, transparency and protection of confidentiality. The processing is carried out using paper and/or computerized methods and includes the operations or set of operations necessary for the pursuit of the purposes mentioned in point 4), namely, by way of example, the identification of the subjects responsible for the infringement, the means used to commit it, as well as the control of any documents.

6. Nature of the processing

The above data and the related documents necessary for driving must be communicated and shown to the Officials and Agents of the Local Police, pursuant to art. 651 of the Penal Code, as well as, by way of example, Law 689/81 and the Legislative Decree n.285/92.

7. Communication and dissemination

Personal data may be communicated to third parties in the cases provided for by the applicable regulatory provisions (Communications to the Judicial Authority, the Prefecture, the Civil Motorization Authority, ATS, as well as other subjects identified by legal provisions or regulations). The Data may also be communicated to third parties who provide services to the Municipality and are linked to it by contractual relationship, solely for the purposes described above, subject to designation as Data Controllers and in any case guaranteeing the same level of protection.

8. Data retention

The data will be kept in the archives of the Organization for the time necessary to complete the sanctioning procedure and will be minimized at the conclusion to the essential data for the preparation of the budget and for the financial reporting of the Organization and held for the term required by law, they will not be sold externally except in the cases provided for by law.

9. Categories of data recipients 

The processing is carried out by authorized persons committed to confidentiality and responsible for the related activities in relation to the purposes pursued.

10. Data transfer to third countries

The data provided for the aforementioned purposes are not transferred to third countries or international organizations, inside or outside the European Union.

11. Rights of the interested parties

Interested parties can exercise the rights provided for by the art. 15 and following of EU Regulation 2016/679 and in particular the right to access your personal data, to request rectification or limitation, updating if incomplete or incorrect and cancellation if the conditions exist, as well as to oppose the processing , contacting the Municipality of Milan as Data Controller, and sending any request to the following structure: Local Police Central Directorate > pl.privacy@comune.milano.it

12. Right to complain

Interested parties, if they believe that the processing of personal data relating to them occurs in violation of the provisions of EU Regulation 2016/679 (art. 77) have the right to lodge a complaint with the Guarantor (www.garanteprivacy.it) or to take appropriate judicial action (art.79)
