Information pursuant to art. 13 of EU Regulation no. 2016/679

Pursuant to art. 13 of EU Regulation no. 2016/679 (General Regulation on the Protection of Personal Data), the following information is provided.

Data controller
The Data Controller of personal data is the Municipality of Milan with headquarters in Piazza della Scala, n. 2 – 20121 MILAN - Specialist Authorizations and Concessions Directorate -SUAP, One-Stop Events Area- at the following address: direzione.sportelloeventi@pec.comune.milano.it .


Data Protection Officer (DPO)
The Municipality of Milan has appointed its own Personal Data Protection Officer who can be contacted at the e-mail address: dpo@comune.milano.it.

Purpose
The processing of data is aimed at managing practices aimed at issuing the following provisions upon request of a party:

  • temporary concessions of public land linked to events;
  • temporary public entertainment licenses;
  • temporary authorizations for the sale and supply of food and non-food goods on public land;
  • Authorizations for photo/video shooting in the historic centre, in municipal buildings and in municipal parks/gardens.

Legal basis
Personal data are processed in compliance with the conditions established by EU Regulation 2016/679 and in particular by art. 6 – par. 1 letter e) and by the art. 2 ter of the Legislative Decree. 196/2023 “Personal data protection code”, for the execution of a task of public interest or connected to the exercise of public powers vested in the data controller in accordance with the Regulation on the single property fee and market concession fee, Consolidated Law on Public Security and related Implementation Regulation, Regulation of the Municipal Commission for Supervision of Public Entertainment Venues, Regional Law n.6/2010, Law 241/1990. The personal data will be used by the data controller as part of the procedure for which the declaration is made.

Types of data processed
The management of the aforementioned procedures involves the collection of the following personal data:

  • Personal data (name and surname, place and date of birth)
  • Residence address and headquarters
  • E-mail address: Ordinary post and/or certified e-mail
  • Tax code or VAT number
  • Phone numbers 

Mode of treatment
The processing takes place in compliance with fundamental rights and freedoms and is based on the principles of correctness, lawfulness, transparency and protection of confidentiality. It is also carried out with the aid of electronic instruments consistently with the operations indicated in the art. 4, point 2, of EU Regulation 2016/679.

Nature of treatment
The provision of data is mandatory and failure to provide it precludes the possibility of completing the preliminary investigation process aimed at issuing the requested provision.

Communication and dissemination
The data, when necessary for the purposes of issuing the aforementioned provisions, may be communicated to third party bodies (ATS in the case of administration and sale). The communication of data is also possible in the cases provided for by Law 7 August 1990, n. 241 (“New rules regarding administrative procedures and the right of access to administrative documents”), where applicable, and in case of checks on the truthfulness of the declarations (art. 71 of the Presidential Decree of 28 December 2000 n. 445 - Consolidated text of the provisions laws and regulations regarding administrative documentation").

Categories of data recipients 
The processing is carried out by authorized persons committed to confidentiality and responsible for the related activities in relation to the purposes pursued.
The data processing is also carried out by the company Berenice International Group srl Tax code/VAT number: IT03506780281 Registered office address: via Savelli 28 – 35129 Padua, which assumes the function of Data Controller pursuant to art. 28 of EU Regulation 2016/679.

Data retention
The data will be kept for the time necessary to achieve the purposes for which they were collected and in any case for the period envisaged by the Document Management Manual of the Municipality of Milan, approved with Municipal Council Resolution n.1568/2011 and subsequent amendments.

Data transfer to third countries
The data processed for the aforementioned purposes are not transferred to third countries outside the European Union or the European Economic Area (EEA) or to international organisations.

Rights of interested parties
Interested parties can exercise the rights provided for by the art. 15 and following of EU Regulation 2016/679 and in particular the right to access one's personal data, to request rectification or limitation, updating if incomplete or incorrect and cancellation if the conditions exist as well as to oppose the processing by contacting the request to:

Right of complaint
Finally, we inform you that interested parties, if they believe that the processing of personal data relating to them occurs in violation of the provisions of EU Regulation 2016/679 (art. 77) have the right to lodge a complaint with the Guarantor, (www.garanteprivacy.it ) or to take action in the appropriate judicial offices (art. 79 of the Regulation).

Modification
The Owner reserves the right to make to this Information, at its sole discretion and at any time, all changes deemed appropriate or made mandatory by the regulations in force from time to time, giving adequate publicity to interested parties.
