Board of Guarantors

The Board of Guarantors is the guarantee body, provided for by art. 21 of the Statute of the Municipality of Milan, to protect citizens' rights to participate in the activities of the Municipality, through popular initiative instruments, such as proposed resolutions or referendums.

Composition and duration

The Board is made up of three members elected by the Municipal Council and remains in office for 5 years.
The position is honorary, as there is no compensation or reimbursement of expenses for carrying out the assigned functions.

The following tasks are assigned to the Board of Guarantors:

  • decide on the admissibility of popular initiative and referendum proposals, as well as on the formulation of questions and the consequent procedures, in the cases and in the manner provided for by the regulations in force;
  • be the guarantor of the correct interpretation of the municipal statute in the event of disputes;
  • carry out all other functions provided for by the Statute.

 

 

Established with a statutory provision in 1991, the Board of Guarantors has been renewed over the years by the municipal council which has elected its members from time to time, choosing them from among magistrates, full professors of universities of legal disciplines, lawyers or notaries with at least 10 years of operation

On 9 January 2023 the City Council with resolution no. 2/2023, choosing from 4 candidates identified through public notice, elected the new Guarantors:

• Prof. Mario Cera
• Lawyer Paola Giulia Belloli 
• Lawyer Marco Luigi di Tolle

At the installation meeting on 31 January 2023, the new Board appointed the lawyer President. Belloli.

On 3 July 2023, Prof. Cera resigned as a member of the Board.

With its resolution no. 70 on 23 October 2023 the municipal council elected prof. Edoardo Carlo Raffiotta replacing the resigning Guarantor.
