Real estate confiscated from organized crime

The Municipality of Milan is the owner of 235 real estate units definitively confiscated from organized crime, transferred to its unavailable assets according to the provisions of the Anti-Mafia Code.

The Municipality of Milan, for social purposes, can:

  • use the properties directly
  • assign the properties under free use concession to third sector entities, through a public notice.

Unassigned real estate can be used for profit, but its proceeds must be reused exclusively for social purposes.

The Administration thus intends to valorise the confiscated assets, in order to allow Milanese citizens to reclaim the resources illicitly stolen from the community, repurposing them and putting them at the service of citizenship and the common good.

The Municipality of Milan is required to:  

  • form and periodically update a specific list of confiscated properties transferred to it
  • make the list public, in appropriate forms and permanently, so that it is always available for consultation
  • indicate in the list, for each property assigned to third parties, the size, destination, use, identification data of the concessionaire, object and duration of the concession. 

Without prejudice to the requirement of non-profit purposes, pursuant to art. 48 of the Anti-Mafia Code and also in reference to art. 4 of Legislative Decree 3 July 2017, n. 117 (Third Sector Code), the following can participate in tenders for the concession of confiscated real estate:

  • voluntary organizations
  • social promotion associations
  • philanthropic organizations
  • social cooperatives 
  • associative networks
  • mutual aid societies
  • the associations
  • the foundations
  • other private entities other than companies established for the non-profit pursuit of civic, solidarity and social utility purposes through the performance, exclusively or principally, of one or more activities of general interest in the form of action voluntary or free provision of money, goods or services, or mutuality or the production or exchange of goods or services.

Individuals can participate individually or as leaders of temporary groupings that also include other non-profit organizations as participants.

Finally, the activities relating to the actions, interventions and services listed in the art. are considered to be of general interest if carried out in compliance with the specific rules governing their exercise. 5, paragraph 1, of Legislative Decree no. 117/2017.

The real estate units can be assigned for free use through a public notice, in compliance with the principles of transparency, adequate publicity and equal treatment.

The concession is regulated by a contract which regulates every aspect (duration, use, causes of termination, etc.).
