Dispersion of ashes: how it works

The ashes can be scattered in compliance with the wishes of the deceased person:

  • in specially designated areas within cemeteries;
  • in nature: for example in the sea, in lakes and rivers it is permitted in areas free from boats and buildings;
  • in private outdoor areas, with the consent of the person who owns the property.

Dispersal is prohibited in residential areas.

Cost of service
The Municipality of Milan applies the following rates:

  • €32,29 for dispersion in nature;
  • €117,97 in the areas identified within the municipal cemeteries;
  • revenue stamp of €16,00 for dispersion authorization, applied virtually.

The deceased person's desire to scatter their ashes can be expressed in the following ways:

  • manifestation of the will in life, declared by the deceased person in a testamentary disposition through one of the following methods:
    - in a writing to be deposited and published by a notary (holographic will);
    - in a public will;
    - in a secret will;
  • lifetime membership in a legally recognized Association, having among its purposes that of cremating the bodies of associated persons.

In the absence of such provisions the will to scatter the ashes of the deceased can be made with a declaration in lieu of an affidavit by the spouse/civil partner.

In the absence of these figures, the will can be expressed by the closest relative within the 6th degree; in the event of the existence of multiple relatives of the same degree, an absolute majority of relatives of the same degree is required.

The declaration in lieu of an affidavit must be presented to the Civil Registry of the Municipality of death, in the case of a funeral or to the Civil Registry of the municipality of burial in the case of exhumation/exhumation.

 

The following can be done to disperse the ashes:

  • a person identified by the deceased person;
  • the spouse or civil partner;
  • another family member;
  • any executor;
  • who legally represents the Cremation Association to which the deceased person was registered.

Two areas intended for dispersal have been identified in the municipal cemeteries.

Grove of remembrance - Major Cemetery
The Grove of Remembrance is a green area in correspondence with field 43, intended for dispersion starting from 2021. Here it is possible to scatter the ashes of people who died in Milan (both residents and non-residents).

The dispersion occurs by direct burial, i.e. with the emptying of the urn inside a pit and subsequent filling and leveling of the ground. It is therefore not possible to place incompatible memorial stones, crosses, signs, vases or objects of any type since the dispersion by burial is not an inhumation and the point where it occurs cannot be identified as a burial place.

At the end of its use, each dispersion sector becomes home to plants and shrubs based on a project (see the file section Attachments) which will be completed with the use of all sectors of field 43 and the planting of all the planned plants and shrubs.

Garden of remembrance - Lambrate Cemetery
Built in 2004, the Garden of Remembrance is a green area near the Crematorium. The ashes are scattered on the surface and conveyed underground through a flow of water.

Here you can scatter the ashes:

• of deceased people or residents in Milan, if requested following the funeral;
• of people already buried in a cemetery in Milan;
• of deceased persons whose foster care had been authorized by the Municipality of Milan following their renunciation.
