Occupations of spaces in Darsena

The Regional Law of 29.10.1998 n. 22 provided for the delegation to the Municipalities of the exercise of functions regarding navigation and state property of internal waters and in compliance with the provision, the "Program Agreement for the conferral of administrative functions in the field of internal navigation and state property".

On 27.05.2003, the Agreement was stipulated between the Lombardy Region and the Municipality of Milan for the delegation of competences over the port area of ​​the Darsena di Milano, identified as per the Ministerial Decree of 20.8.56 (basin of the Darsena di Porta Ticinese proper, trunk of Naviglio Grande which goes from the Darsena at Via Casale and the section of Naviglio Pavese which goes from the Darsena to Via E. Gola).

With resolution of the City Council n. 12 of 17.5.2017, "the Regulation for the regulation of the administrative functions delegated to the Municipality of Milan relating to the Darsena Port Area" was approved.

Temporary concessions for spaces on land and in water are issued for the holding of events/events contingent on the following conditions and methods:

  •  event of city interest and not strictly commercial interest;
  •  duration not exceeding 10 consecutive days, non-renewable/extendable: only with a temporary interruption of employment of a further 30 consecutive days is a new concession application from the same entity admissible;
  •  any temporary demonstration/event cannot begin before 7:00 am and continue beyond midnight on the same day, excluding pre-holidays and New Year's Eve;
  •  the request and the related necessary documentation must be received no less than 40 days before the fixed date of commencement of employment and no earlier than 120 days of the same: failure to comply with these deadlines will result in the inadmissibility of the request.
  •  fee: is calculated by applying the fee provided for by the COSAP Regulation, approved by resolution of the City Council no. 11 of 21.02.2000 and subsequent amendments, using the coefficient relating to the road classification envisaged for Piazza Duomo.
  • If the fee, quantified in the manner indicated in the previous paragraph, is lower than one of the table minimums provided for in tables B (concessioned area) and C (work or structure) Annex II of the Regional Regulation 27.10.2015 n. 9, with the maximum increase of 30% foreseen by the agreement signed on 27.05.2003 between the Lombardy Region and the Municipality of Milan, the single fee due is reduced to the highest value of the table minimums themselves;
  •  the request is subject to the acquisition of a favorable opinion from the Inter-council Committee pursuant to GC resolution n.1217/2016.
  •  To request employment in the water it is advisable to check the dry calendar in the attachments section.

Temporary mooring concessions are issued for the purpose of mooring navigation units with dimensional characteristics established by the Regional Regulation of 29 April 2015 n. 3 – Nautical traffic on the Navigli Lombardi and connected waterways.

  •  stable shelter of a navigation unit on a water space dedicated to this purpose, without carrying out any activities such as promotional, advertising, commercial and entertainment activities
  •  minimum duration of 1 day and maximum of 10 days even non-consecutive.
  •  the request and the related documentation must be received no less than 15 days before the fixed date of commencement of employment and no earlier than 40 days of the same: failure to comply with these deadlines will result in the inadmissibility of the request.
  •  daily fee: is equal to 5% of the annual mooring fee, quantified according to the methods indicated in the following paragraph, and in any case not less than €20,00 per day.

The fee is calculated in reference to the space occupied "length by overall width" of the navigation unit and is determined on the basis of the unit measurements indicated in table A of Annex II of the Regional Regulation 27.10.2015 n. 9 and subsequent amendments, with the maximum increase of 30% provided for by the agreement signed on 27.05.2003 between the Lombardy Region and the Municipality of Milan.

The unit measures of the fees indicated in Table A are updated annually based on the ISTAT index published by order of the competent Regional General Directorate

  • The concession fee paid refers solely to the occupation of the assigned water space and does not imply any right to the supply of goods and services however named.

The concessions for the holding of nautical events are issued for the purposes of navigation safety, in the municipal context.

Speed ​​boat races with any motorized navigation unit are excluded.

The request must be submitted at least 40 days before the date of the event.

Fishing is permitted along the entire bank of the Darsena Lato Viale d'Annunzio without creating an obstacle to navigation units, pedestrian passage and existing activities.

All responsibility for people and things remains with the fisherman.

Due to the risks associated with collective use and the dangerousness of the waterways, bathing and underwater activities are prohibited, unless expressly exempted in the context of authorized demonstrations/events.
