Municipal Supervisory Commission

The Municipal Supervisory Commission (CCV), as a perfect administrative collegial body, was established in Milan on 7 March 1990, following the decision of the Council of State which recognized the Municipality of Milan as the owner of the technical assessment aimed at issuing the license for use for public entertainment venues and temporary events and remains in office for a period of three years.

The composition of the Municipal Supervisory Commission (CCV), with reference to the provisions of the Art. 141-bis, RD 6 May 1940, n. 635 and since regulation of the municipal supervisory commission on public entertainment venues approved with City Council Resolution no. 109 of 1996 and modified with City Council Resolution no. 40 of 24 May 2021, is as follows:

  • Mayor or his delegate who presides over it;
  • Commander of the Local Police Force or his delegate;
  • Medical director of the basic public health body competent for the territory or by a doctor delegated by him;
  • Manager of the municipal technical office - structural expert - or his delegate;
  • Manager of the municipal technical office - electrotechnical expert - or his delegate;
  • Provincial Fire Brigade Commander or his delegate.

The members of the Municipal Supervisory Commission mentioned above are considered to have necessary participation.

If necessary, one or more experts in acoustics or other technical disciplines may be invited in relation to the technological equipment of the room or system being checked. In the case of sports facilities, in relation to the provisions of the Ministerial Decree of 18 March 1996 and subsequent amendments, the President of CONI or his delegate must be associated with the Commission in a consultative capacity. An official belonging to the Management of the Municipality of Milan responsible for issuing the occupancy and/or operating license may also be invited by the President, if deemed necessary and for purely consultative purposes.

At the request of the proponent, a representative of the operators of public entertainment venues or a representative for temporary events may participate in the Commission.

For each member of the CCV, the presence of one or more substitute members may be foreseen who participate in the sessions and/or inspections only in the event that the owner, or possibly the person delegated by him, cannot, for undeferrable reasons, intervene.

The skills of the CCV are established by the Art. 4, of the Presidential Decree of 28 May 2001, n. 311, which modified Articles 141 and 142, RD 6 May 1940, n. 635, as specified below:

  • cinema or theater venues with a capacity of less than or equal to 1300 spectators;

  • traveling shows with a capacity of less than or equal to 1300 spectators;

  • other venues or sports facilities with a capacity of less than or equal to 5000 spectators;

  • amusement parks and mechanical or electromechanical amusement equipment that involve physical stress on the spectators or public participating in the games lower than or equal to the levels indicated by decree of the Minister of the Interior, in agreement with the Minister of Health.

The task of the CCV is to verify the solidity and safety of the building to be used for public entertainment activities and the existence of exits fully suitable for clearing it promptly in the event of fire, as stated in the Art. 80, RD n. 773/1931 – TULPS.

Specifically, the CCV expresses its opinion of usability on the projects of new premises to be used for public entertainment activities, on the variations of existing premises, on the staging of temporary events, carries out periodic checks on the permanence of the general safety conditions of the structures and places listed in 'Art. 1, Ministerial Decree 19.08.1996, with particular reference to theatres, cinema-theatres, cinemas and multiplexes, auditoriums and conference halls, entertainment venues, ballrooms, discos, tent theatres, circuses, places intended for traveling shows and amusement parks , open-air places or places located in delimited open-air spaces equipped with systems specifically intended for shows or entertainment and with special structures for the parking of the public, sports facilities where there are stands for the public, multi-purpose rooms used occasionally for entertainment and public entertainment, etc.

The Secretariat of the CCV acts as a support to the Commission's activity, takes care of the management of the administrative activity connected to the expression of the usability opinion, prepares the documents necessary for its functioning.
