To which interventions and from what date should the Regional Regulation of 23 November 2017 n°7 be applied, containing criteria and methods for respecting the principle of hydraulic and hydrological invariance?

The interventions required to comply with the principle of hydraulic and hydrogeological invariance referred to in art. 58 bis paragraph 2 of L.R.12/2005, are specified in the art. 3 of the R.R. 23 November 2017 n. 7 and subsequent amendments.
It should be noted that starting from 01/01/2020, following the expiry of the specific extension period, the application of the aforementioned regulation also concerns the following interventions:

  • building renovation consisting of total demolition, at least up to the lowest level of the ground level adjacent to the building, and reconstruction with an increase in the covered surface area of ​​the demolished building (art. 3 paragraph 2 letter to R.R. no. 7/2017 );
  • extensions (art. 3 paragraph 2 letter b of the R.R.):
  • urban restructuring referred to in art. 3 paragraph 1 letter. f of Presidential Decree 380/01.

 Starting from 28/05/2018, the regional measures of hydraulic and hydrogeological invariance will apply for the further interventions indicated in the art. 3 of the R.R., in compliance with the specific indications relating to the time reference contained in the art. 17 paragraph 3 of the same R.R.
 To the presentation of PdC or SCIA it is necessary to attach:
hydraulic and hydrological invariance project drawn up by a qualified technician and, depending on the project proposal, one of the following: 

  • application for concession to discharge presented to the competent hydraulic authority, if the discharge itself takes place in a body of surface water; 
  • connection request presented to the manager, in the case of discharge into the sewer; 
  • agreement between the person requesting the unloading and the owner, in the case of unloading in a private network.

9) Interventions relating to road and motorway infrastructures, their appurtenances and car parks, having the characteristics indicated by the R.R. n. 7 of 2017 with the exclusion of: ordinary and extraordinary maintenance interventions on the cycle-pedestrian, road and motorway network, modernization (with the exception of the construction of new roundabouts with an external diameter greater than 50 m on roads other than urban neighborhood roads (type E ), local roads (type F), cycle/pedestrian itinerary (F-bis) classified by the New Highway Code). Road upgrading interventions for the aforementioned roads and the construction of new F-bis type roads (cycle/pedestrian itinerary) are excluded.
