I have to design an elevator in an existing residential building in derogation of the architectural barrier rule regarding the clear width of the cabin. What is its minimum width?

Pursuant to art. 4 of the Ministerial Decree 236/89 (Design criteria for accessibility) the lift must have a cabin of minimum dimensions such as to allow its use by a person in a wheelchair; art 8 of the same Ministerial Decree. in the case of adaptation of pre-existing buildings, where a higher measurement is not possible, identify the minimum width of the cabin as 0,80 m. 
Similarly, in the L.R. 6/89 (in point 5 of the annex) the width of the cabin is identified as 0,90 m.

The art. 20 of the same Regional Law. provides that concessions up to conservative restoration can be issued in derogation in the case of the existence of constraints established pursuant to current legislation for the protection of environmental assets and/or the technical impossibility connected to static and plant elements of the buildings subject to intervention and that for this purpose the designer is required to justify, document and sign this technical impossibility, developing alternative solutions to the provisions of the annex, suitable for guaranteeing the use of the property according to the purposes of the Law.

In this sense, it is possible to request an exemption for the size of the elevator cabin smaller than the minimum which therefore takes into account the constraints indicated above. In particular, in the case of installation of lifts in the common stairwells of existing buildings, the reduction of the ramp width to a minimum of 0,85 m is permitted. (art. 89 R.E.), in compliance with fire prevention regulations.
