In the case of recovery of an attic, it is possible to exceed the average weight height of 2.40 m. in order to respect the morphological rules of the PGT?

It is not permitted to exceed the average height and weight of 2.40 m. in order to respect the morphological rules of the PGT as pursuant to art. 63 paragraph 5 of the Regional Law. 12/2005 the recovery of the attic is permitted in compliance with all health and hygiene requirements and, as provided for by art. 63 paragraph 6 of the Regional Law. 12/2005, the increase in heights must take place by ensuring the average weight height of 2.40 m for each individual property unit.

In this sense, therefore, the average weight height of 2,40 metres, measured at the intrados of the attic, must be considered both the minimum height - for the habitability of the premises - and the maximum height for the entire real estate unit, while the services toilets, ancillary rooms and service rooms may have average weight heights of less than m. 2.40 but not at m. 2.10, as established in the Building Regulations.

Finally, it should be specified that the art. 64 paragraph 2 of the Regional Law. 12/05 establishes that the recovery of existing attics for residential purposes is also permitted in derogation of the limits and provisions of the municipal planning instruments in force and adopted and therefore also of the morphological rules of the PGT (with the exception of the finding of appurtenant parking lots).
