In the case of a renovation project in a building intended partly for RSA and partly for healthcare equipment, it is possible to apply the Ministerial Decree. 801/1977 for calculating the construction cost?
The Ministerial Decree 801/1977 provides for the possibility of applying a discounted price only and exclusively for residential use.
Pursuant to art. 19 Presidential Decree 380/01, the burden commensurate with the construction cost must be calculated by estimating the works with the Estimated Metric Computation, evaluated with the Price List of the construction works of the Chamber of Commerce.
To this amount of the works, which pursuant to art. 48.6 of Regional Law: 12/05 modified by art. 4.1.h from L.R. 18/19 cannot exceed 50% of the value of the new construction, the rate of 10% will apply.
