Civil unions

Civil union is a legal institution provided for by Italian law to formalize relationships between two adults of the same sex.

To establish a civil union, the couple can freely choose the municipality to contact, regardless of their place of residence.

  • Within 30 days of drawing up the minutes, the Civil Registrar will carry out all the necessary checks to ensure that there are no impediments and will communicate the outcome to the interested parties.
  • the civil union will be established within 180 days of the formal communication of the closure of the checks.

The celebration must take place:

  • within 180 days of the formal communication of the absence of impediments by the civil registrar
  • on the days and times available at the identified location

Costs for the celebration
Celebrations in Milan include the following rates:

  • ordinary time: from 9am to 30pm and from 12pm to 30pm (excluding Saturdays and holidays)
    - free of charge if at least one person getting married is resident or registered in the Registry of Italians residing abroad (AIRE) Milan
    - €500,00 for non-residents
  • outside normal hours: from 16pm to 00pm and on Saturdays from 17am to 00pm
    - €96,00 if at least one person getting married is resident or registered with AIRE Milan
    - €596,00 for non-residents.

Payment - by debit card only - is required at the time of booking.

Two witnesses with valid identity documents must be present at the celebration.

At the time of incorporation, the contracting parties can choose a common surname and place it before or after their own.

  • The chosen surname will not appear in the certifications personal details and marital status and therefore there will be no change in the tax code.

The civil union automatically entails the patrimonial regime of community of property.

The parties can choose the regime of separation of assets when establishing the union.

If at least one person in the couple is a foreigner, the parties can agree in writing that their property relations will be governed by the law of the State of which at least one of them is a citizen or in which at least one of them resides.
