Marriage

The marriage process includes the request for publication in the praetorian register and the subsequent celebration of the rite.

The marriage publication consists of posting it to the online noticeboard (usually eight days + three for any appeals).

  • in the case of residents abroad or foreign people not resident in Milan, consult the paragraph Useful news and special cases.

Cost

  • Basic cost: €16,52
  • if the spouses reside in two different municipalities: €32,52
  • if the civil ceremony takes place in another Municipality: add an additional €16,00 to the cost of the publications

Starting from the fourth day following the end of the display on the notice board (i.e. the eight days of publication + three for any appeals), in the presence of the successful outcome of the publications:

  • for civil weddings to be celebrated in Milan - you will be contacted to book the ceremony in the halls of the Municipality of Milan (see instructions for the celebration in the section Use the services)
  • for civil marriages in another Municipality - the delegation for the celebration in the other Municipality is issued
  • for weddings with a religious ceremony - is released on clearance to be delivered to the parish priest.

For everyone, the deadline within which to celebrate the wedding is 180 days.

Costs for the celebration
Celebrations in Milan include the following rates:

  • ordinary time: from 9am to 30pm and from 12pm to 30pm (excluding Saturdays and holidays)
    - free of charge if at least one person getting married is resident or registered in the Registry of Italians residing abroad (AIRE) Milan
    - €500,00 for non-residents
  • outside normal hours: from 16pm to 00pm and on Saturdays from 17am to 00pm
    - €96,00 if at least one person getting married is resident or registered with AIRE Milan
    - €596,00 for non-residents.

Payment - by debit card only - is required at the time of booking.

Two witnesses with valid identity documents must be present at the celebration.

Marriage automatically entails the community property regime only for purchases made after marriage.

The spouses can choose the separation of assets by declaring it at the time of marriage or, later, before a notary.

  • In the event of separation of assets, each spouse also remains in exclusive possession of the assets acquired after the marriage.

If both spouses are resident abroad (registered with AIRE)

  • For marriage banns it is necessary to contact the Italian Consulate competent for the territory.


If only one of the spouses is resident abroad (registered with AIRE) and the other is resident in Milan

  • Publications can be requested without distinction from the Consulate or the Municipality. However, it is suggested to carry them out in the place where the wedding will be celebrated.


For non-resident foreigners

In case of previous divorce

  • It is not necessary to present any documents but before starting the publication procedure it is necessary to make sure that the personal data is updated.


Italian and foreign women who have obtained a divorce abroad

  • If 300 days have not passed from the date of dissolution or cessation of the civil effects of the previous marriage, it is necessary to present:
    - a copy of the foreign divorce decree
    - the authorization of the Civil Court.


Women widowed for less than 300 days

  • They must ask for authorization from the Civil Court.


Marriage of minors

  • The minimum age for marriage is 16 years of age
  • Before the age of 18, authorization from the Juvenile Court is always required.


Authorization or certificate of marital capacity for foreign citizens

  • They must be requested from the diplomatic authority of your country
  • the authorization must be previously legalized at the Prefecture of Milan, if there are no international conventions between Italy and the state to which the groom or bride belongs which establish the exemption
  • if the authorization has incomplete personal data, a birth extract on a multilingual form is also required (or translated by the Consulate, Embassy or translator expert).
