Environmental Impact Assessment - EIA

The Environmental Impact Assessment (EIA) is a technical-administrative procedure aimed at:

  • to the analysis of projects that may have significant impacts on the environment
  • to identify the most suitable solutions for pursuing environmental sustainability objectives.

Purposes and objectives
The purpose of the EIA is to protect human health, improve the quality of life, maintain species and their reproductive capacity. 

The objectives are the following:

  • predict and estimate the direct and indirect effects of a project on the environment, in its various aspects (from natural to anthropic, socio-economic and cultural ones)
  • identify and evaluate possible alternatives, including non-implementation of the project (so-called zero alternative)
  • establish the conditions for the construction and operation of the works and systems, indicating the measures for minimizing or eliminating the related impacts.

The contribution is paid by the Proponent and is calculated as per the explanatory indications contained in the Implementing regulation.

The sum paid for the procedure for verifying eligibility for EIA or for carrying out the optional phase will be deducted from the investigation costs of the EIA procedure in the following cases:

  • project subjected to EIA following verification of eligibility
  • project subject to EIA for which the optional consultation phase with the competent authority has been carried out.

1. Description of the project, including in particular:

  • physical characteristics of the overall project and, where relevant, of the demolition works
  • location of the project, in particular with regard to the environmental sensitivity of the geographical areas that may be affected.

2. The description of the components of the environment on which the project could have a significant impact.

3. A description of all likely significant effects of the project on the environment, to the extent that information on such effects is available, resulting from:

  • residues and expected emissions and waste generation, where relevant
  • use of natural resources, in particular soil, territory, water and biodiversity.

4. When preparing the information and data referred to in points 1 to 3, the criteria contained in the legislation are taken into account, where appropriate.

5. The Preliminary Environmental Study takes into account, where appropriate, the available results of other relevant environmental effects assessments carried out under European, national and regional regulations. It may contain a description of the characteristics of the project and/or the measures envisaged to avoid or prevent what might otherwise represent significant and adverse environmental impacts.

Agriculture

  • Change of use of uncultivated, semi-natural or natural areas for their intensive agricultural cultivation with an area > 10 hectares
  • Fish farming for a total area > 5 hectares

Infrastructure Projects

  • Car parks with a capacity of more than 500 cars
  • Construction of shopping centers with sales areas of up to 2.500 m10.000. in municipalities with a population exceeding XNUMX inhabitants. By construction we do not mean the type of building intervention, but rather any intervention that results in the establishment of a new shopping centre.

In order to avoid the artificial fragmentation of projects, the criterion of cumulation with other projects belonging to the same project category and falling within the same territorial area applies, within which cumulative impacts on the different environmental components cannot be excluded.

1. Start the verification
At the start of the verification of eligibility for municipal EIA, the proponent must send the preliminary project to the Environmental Authorizations and Land Management Unit. The project must be accompanied by a Preliminary Environmental Study which describes: the project, its location, dimensions and data necessary to identify and evaluate the main effects that the project may have on the environment.

2. Consultation and observations
Following the initiation and presentation of the documents, the consultation phase opens, through which anyone with an interest can view the deposited documentation and present their observations on the merits to the competent Authority.

3. Evaluation
The Competent Authority evaluates both the Preliminary Environmental Study and any observations received and decides on whether or not to be subject to an EIA procedure, or on any requirements for the mitigation of impacts and their subsequent monitoring.

The Administration has identified the Water Resources and Environmental Hygiene Area - Environmental Authorizations and Land Management Unit as the Competent Authority for municipal EIA procedures.

 Legislative Decree no. 104/2017 as well as amending numerous articles of Title III (the Environmental Impact Assessment) of Part Two of Legislative Decree no. 152/2006, introduces ANNEX IV-bis - Contents of the Preliminary Environmental Study referred to in article 19. The contents are shown below:
