Exceptions to the period/hours of operation for all activation systems (Resolution no. XI/3502 - Lombardy Region)

• buildings used as hospitals, clinics or nursing homes and similar buildings, including those used for the hospitalization or care of minors or the elderly, as well as protected structures for the assistance and recovery of drug addicts and other subjects entrusted to public social services
• headquarters of diplomatic representations and international organizations, which are not located in condominium buildings
• buildings used as nursery schools and nursery schools
• buildings used for swimming pools, saunas and similar
• buildings used for industrial, artisanal and similar activities, in cases where technological or production needs persist

Exceptions limited to the daily duration of activation (Resolution no. XI/3502 - Lombardy Region)

• buildings used for offices and commercial activities or similar, limited to the parts used for services without daily interruption of activities
• heating systems that use heat from cogeneration plants with combined production of electricity and heat
• heating systems that use radiant panel heating systems embedded in the masonry
• heating systems serving one or more buildings equipped with a primary circuit, aimed exclusively at powering the buildings referred to in the exemptions provided for in paragraph 5, for the production of hot water for hygienic and sanitary purposes, as well as for the purpose of maintaining the temperature of the water in the primary circuit to the value necessary to guarantee the operation of the secondary circuits within the expected times
• heating systems serving multiple residential and similar real estate units, equipped with a thermoregulatory unit driven by an external temperature detection probe with programmer that allows the regulation of the room temperature on at least two levels over a 24-hour period; these systems can be operated continuously as long as the daily programmer is calibrated and sealed to reach a room temperature of 16° C + 2° C tolerance in the hours outside the daily duration of activation, referred to in the paragraph 7 of this point
• heating systems serving multiple residential and similar real estate units on which a heat accounting system and a thermoregulation system for the room temperature of the real estate unit itself are installed and functioning in each individual real estate unit, equipped with a programmer that allows the regulation of said temperature on at least two levels over a 24 hour period; the programmer must in any case be programmed in such a way as not to exceed the maximum daily hourly activation limit for the single real estate unit, as provided for in paragraph 7
• heating systems for individual residential and similar real estate units equipped with a room temperature thermoregulation system with a daily programmer that allows the regulation of said temperature on at least two levels within 24 hours as well as the switching off of the heat generator based on the needs of the the user, provided that the programmer is programmed in such a way as not to exceed the maximum daily hourly activation limit, as provided for in paragraph 7
• heating systems conducted through "energy service contracts" or "energy performance contracts", where the fees are related to the achievement of environmental comfort within the limits permitted by this device, provided that this is done, during the hours outside the duration of activation of the systems permitted by paragraphs 7 and 8, to reduce the power supplied by the system within the limits indicated in letter e)

Exceptions to room temperatures

• hospitals, clinics or nursing homes and similar, including those used for the hospitalization or care of minors or the elderly, as well as protected structures for the assistance and recovery of fragile subjects or those entrusted to public social services, are excluded from compliance of paragraphs 1 and 2 of Resolution no. XI / 3502, limited to the areas reserved for the stay and medical treatment of patients or guests
• for buildings used as swimming pools, saunas and similar, for the headquarters of diplomatic missions and international organizations not located in condominium buildings, the Municipalities may grant justified exemptions from the temperature limits referred to in paragraphs 1 and 2, if objective elements or needs linked to the specific intended use justify different temperatures of said values
