The Administration had intervened to demolish illegal building works. Maran: "Battle won"

Milan, October 18 2019 - "The actions of the Municipality are fully legitimate, as they first ordered the demolition of the illegal interventions and then, having taken note of the non-compliance of the private individual with the aforementioned order, ordered the acquisition of the property to the municipal heritage, with subsequent demolition". This is what was reported in the sentence with which the Lombardy Regional Administrative Court rejected the appeal of the owner of the building in via Isimbardi 31, Stadera district, against the intervention launched last year by the Administration to demolish the illegal works carried out.
The property, once used as a laboratory for tertiary use, had in fact been transformed by the owner into small apartments through illicit interventions. In response to the non-compliance of the private individual, who was asked several times to restore the building to its initial state, the Municipality had exercised its replacement powers and started the demolition works, which were suspended in January by a ruling from the Council of State.

Now the ruling of the TAR, which had already previously ruled in favor of the Municipality, once again legitimizes the actions of the Administration.

“We hope that this is finally the last chapter of a long administrative and judicial battle, fought with ordinances from the Municipality and appeals from private individuals - declares the councilor for Urban Planning Pierfrancesco Maran -. I thank the Urban Planning and Lawyers offices who have been working for years to restore legality in via Isimbardi 31, we hope to resume the demolition work as soon as possible".
