Lyric Theatre. The Council of State confirms the correctness of the Administration's actions
Show Bees' appeal rejected in every respect
Milan, June 28 2019 – The V section of the Council of State accepted the appeal of the Municipality of Milan, deeming legitimate all the measures with which the Administration identified the concessionaire of the Opera House, Stage Entertainment s.r.l.
With an articulated and rich motivation, the Council of State completely reformed the sentence of the Lombardy TAR, deeming all the complaints formulated by the second place, Show Bees, against the measures of the Municipality of Milan, to be unfounded.
In particular, the Council of State analyzed the documents in detail and confirmed the procedure for awarding the Opera House as a concession of a public good, and not a "mixed concession having as its object a local public service". Therefore, correctly, the tender documents were preceded by a policy resolution from the Council.
Also confirm the award procedure and the evaluation of the criteria contained in the notice.
Finally, the Council of State considered that the tender operations were carried out without any violation of the rules of transparency, publicity and equal conditions.
