Set some rules to combat disturbance of public peace and maintain decorum. The resolution with the definitive rules will be issued soon

Milan, October 20 2020 – Until 31 December, traders will be able to continue to take advantage of the simplified procedure for requesting the occupation of public land and the exemption from paying the COSAP tax.

This was established by a council resolution, which will have to be approved by the city council in the next few days, containing the provisions to allow the premises to continue to have temporary outdoor spaces, also guaranteeing public peace, decorum and environmental protection.

With the rules set in May by the City Council, over 2.400 commercial activities have been able to recover outside spaces sacrificed inside based on distancing measures. If on the one hand the provision will extend the spaces already granted and the methods for obtaining them, on the other hand in the coming weeks, through a further resolution, the rules to regulate the activity in the years to come, starting from 2021, will be established.

The provision allows operators to add electrically radiated heating elements to the furnishings requested under concession, in compliance with the technical requirements that will be provided by the Administration.

Without prejudice to the government provisions currently in force regarding epidemiological prevention from Covid-19, the resolution allows the Administration, through specific ordinances, to define different opening and closing times - also regulating differently between the activity conducted within the local and that on the terrace - of individual businesses or certain streets, neighborhoods, areas and areas most affected by population density, public order problems or related to noise and environmental pollution.

Also in order to avoid problems of safety and public order connected to the consumption of alcoholic beverages and the abandonment of bottles, with consequences also in terms of protection of the environment and urban decorum, a ban on their sale may be introduced in specific time slots takeaway, including through vending machines, of drinks in glass or tin containers, except for home delivery.

The managers of the activities must, on the one hand, contain the phenomena of degradation and disturbance to public peace, and on the other, ensure the complete cleaning of the concession areas and neighboring ones, ensuring the removal of the waste produced by their own activity and that of the patrons of the premises. To this end, administration activities, including takeaways, are required to equip themselves with special containers for waste collection including ashtrays.

External sound diffusion is prohibited, without prejudice to the full application of the provisions regarding the containment of noise pollution and the related noise emission limits. Finally, the sanctioning system to be applied in cases of disturbance to public peace and violation of the ban on gatherings also through the occupation of spaces exceeding the concession of the exercise or the legislative provisions regarding the prevention of the epidemiological spread of Covid-19 is clarified. Upon the first assessment of violation with the issuing of a report, the granted public land concession will be suspended for up to 3 days, upon the second assessment, suspension will be ordered for 5 days while upon the third assessment, the authorization will be immediately forfeited.
