AMENDMENT ACT - IN ACCORDANCE WITH ART. 7 OF THE L.R. 29.11.2019, N. 19 AND WITH EFFECT OF URBAN PLANNING VARIANT - OF THE PROGRAM AGREEMENT SIGNED ON 4 JUNE 2004 BETWEEN THE MUNICIPALITY OF MILAN AND THE LOMBARDY REGION FOR THE IMPLEMENTATION OF THE INTEGRATED INTERVENTION PROGRAM CALLED «MONTECITY-ROGOREDO» 

NOTICE OF MADE AVAILABLE - WITHIN THE CONTEXT OF THE STRATEGIC ENVIRONMENTAL ASSESSMENT PROCEDURE (SEA) - OF THE ENVIRONMENTAL REPORT AND THE NON-TECHNICAL SUMMARY WITH CONTEXTUAL FILING AND PUBLICATION OF THE DOCUMENTS CONCERNING THE PROPOSAL FOR VARIANT TO THE PII

THE DIRECTOR

Given that

• with  provision of the Municipal Council n. 1511 of 08.09.2017 approved the guidelines for starting the procedure aimed at subsequent promotion by the Mayor, pursuant to article 6 of LR 14/03/2003, n. 2 in force at the time, of the Act Amending the Program Agreement in question, with the effect of an urban planning variant, as well as the contextual start of the V.A.S. procedure, and the related appointment of the Proceeding Authority - in the Thematic Planning and Area Enhancement Area - and the Competent Authority - Water Resources and Environmental Hygiene Area (formerly Environment and Energy Area) -  in matters of SEA; 
• with managerial determination no. 75 of 18.12.2017, it identified the competent subjects in environmental matters and the territorial bodies interested in SEA.
• on 21 December 2017 it published the notice of start of the SEA procedure on the regional (SIVAS) and municipal institutional websites; 
• on 22.12.2017 made the Scoping document available through publication on the regional (SIVAS) and municipal websites;
• on 17.01.2018 convened the first SEA Conference for the discussion of the Scoping document. Following the re-processing of the documentation, on 21.11.2019 the Operator presented the definitive proposal for Integrated Intervention Program involving Urban planning variant, with the relative ENVIRONMENTAL REPORT , NON-TECHNICAL SUMMARY, documentation definitively updated on 5 May 2020 and the subject of this publication.

• Directive 2001/42/EC of the European Parliament and of the Council concerning the evaluation of the effects of certain Plans and Programmes, of 27.06.2001;
• Law 7.8.1990 241/90 and subsequent amendments. “New Rules on Administrative Procedure”;
• Legislative Decree 30.6.2016 n. 127 “Regulations for the reorganization of the regulations regarding the conference of services, in implementation of the Art. 2 of Law 7 August 2015 n. 124”; 
• the Legislative Decree 18.8.2000 n. 267 “Consolidated Law on the Organization of Local Authorities”; 
• the Legislative Decree. 03.04.2006 n. 152 “Environmental Regulations”
• Law 17.08.42 n. 1150 and subsequent amendments. “Town planning law”:
• the L.R. 11.5.2005, n. 12 and subsequent amendments. for the Territorial Government;
• Annex 1m of the DGR n. IX/761 of 10.11.2010;

Given the continuation of the ongoing health emergency and in light of the limitations, restrictions and precautions imposed by the Legislative Decree. March 25, 2020, n. 19;

MAKES YOU KNOWN

the ENVIRONMENTAL REPORT , NON-TECHNICAL SUMMARY they are stored for sixty days to make time from 7 May 2020 until 6 July 2020 and are available for consultation only and exclusively in digital format on the regional SIVAS website, as well as on the institutional website of the Municipality of Milan.

Any communication relating to the procedure in question must be sent exclusively, within the aforementioned deadlines, to the following PEC addresses:

pursuant to art. 34 of Legislative Decree 18 August 2000, n. 267 and pursuant to and for the purposes of article 7, seventh paragraph, of the Regional Law of 29 November 2019, n. 19,

ALSO NOTICE

that the documents concerning the definitive proposal of Integrated Intervention Program, involving an urban planning variant, will also be made available starting from 7 May 2020.

In this case, paragraph 7 of the art. does not apply. 7 LR 19/19 regarding the filing and consultation of the Variation project at the Municipal Secretariat and therefore the same is made available to the public only through publication on the regional SIVAS website, as well as on the institutional website of the Municipality of Milan.

By virtue of the simultaneous publication of the documents relating to the SEA, the filing deadlines as well as the deadlines for submitting observations to the variant proposal are established in 30 days.

Consequently, any observations on the project in question and any accompanying graphics must be forwarded exclusively by PEC addressed to planningtematicavalorizzazionearee@postacert.comune.milano.it with the indication in the subject of “Osservazioni Variante MSG/20”,  by 12.00 on 6 July 2020.

This submission deadline is peremptory and therefore any observations received after the deadline itself will not be taken into consideration.
