Palazzo Marino. The TAR rejects the suspension and confirms the exclusion of the company cited in the 'Soup Kitchen' investigation

Milan, July 11 2019 – The TAR rejected the request for suspension presented by a company against the acts with which the Municipality of Milan canceled the awarding of the tender for 'maintenance and renovation of overpass and underpass structures' and excluded the company from the tender for the reconstruction of the athletics track of the Civic Arena.

The acts which are the subject of the appeal are two of the 11 measures ordered by the Municipality (seven exclusions, one annulment of the award and three rejections of subcontracts) after the recognition of the companies involved in the investigations of the 'Soup Kitchen' investigation.

With two separate orders, the first section of the Administrative Court recognized the correctness of the procedure implemented by the Municipality but above all the clarity of the reasons that determined the two measures. The exclusion - we read in the provision - is not the consequence of the slavish transposition of the contents of the order adopted by the criminal judge, but carries autonomous assessments, anchored to independent assessments and expresses entirely reasonable considerations regarding the existence of a serious error professional, suitable to determine the exclusion of the appellant.
