Milan, May 25 2021 – It was held today, during a ceremony in the Clock Room a Palazzo Marino, the presentation of the two degree prizes in memory of the lawyer Giorgio Ambrosoli, promoted for almost twenty years by the municipal administration and awarded to young graduates or researchers who have explored the theme of ethics applied to economic activity, through a thesis master's or doctoral degree.

The deputy mayor Anna Scavuzzo took part in the ceremony on behalf of the Municipality, together with the members of the commission, the lawyers Umberto Ambrosoli and Tiziano Barbetta and the professor Vittorio Coda; Also present were the President of the Municipal Council Lamberto Bertolé and the General Secretary of the Municipality Fabrizio dall'Acqua.

The two prizes, worth five thousand euros each, went to Beatrice Fragasso, University of Milan, Master's Degree in Law, for the thesis entitled "Police provocation and criminal responsibility: Europe, Italy, United States" and to Vincenzo Costa , LUISS Guido Carli University of Rome, Master's Degree in Law, for the thesis entitled "The elusive and fraudulent use of shell companies in criminal tax law".

"This award – said Deputy Mayor Scavuzzo – is a commitment for the Administration that is renewed every year with conviction: the human and professional story of Giorgio Ambrosoli has marked the history of our city and the country, it is an example of love for the institutions, rectitude and moral integrity that confirm it as a point of reference for all".

For the 2020 edition, 17 theses arrived (14 degree theses and 3 doctoral theses). The Commission has decided to reward the two winning theses of the competition with the reasons given below.


COSTA VINCENZO – LUISS Guido Carli University of Rome – Master's degree in Law.

"The elusive and fraudulent use of shell companies in criminal tax law". Rapporteur: Prof. Filippo Sgubbi – Co-rapporteur: Prof. Elisa Scaroina.

MOTIVATION:

This is a thesis in economic criminal law that analyzes the reality of shell companies and their possible uses in the field of tax law and criminal law.

The candidate examines the different typologies and pathological functions of these societies with a substantial approach. He offers an overview that also allows us to grasp the difficulties with which the legal system (in a regulatory, applicative and interpretative perspective) is called upon to deal with tax violations that occur through this type of vehicle, whose operation has often cross-border nature.

The analysis of concepts such as tax evasion, fraud and abuse of rights is carried out with its own clarity and contribution, without leaving the explanation to the legislative dictates or jurisprudential reference.

The thesis deserves to be rewarded for the relevance of the problem addressed, the depth of analysis, the clarity of presentation and the capacity for synthesis.


FRAGASSO BEATRICE - University of Milan – Master's Degree in Law.

MOTIVATION:

Beatrice Fragasso's thesis concerns aspects of the criminal procedural discipline of considerable sensitivity and of great importance in terms of the guarantees to be guaranteed to the people involved in the investigations.

The theme of the agent provocateur is treated with scientific rigour, in a comparative perspective which includes a detailed analysis of jurisprudential practices.

The problem of distinguishing the figure of the agent provocateur from that of the undercover agent is addressed with competence.

The personal contribution is also notable with reference to the prospects for the evolution of current legislation.
