OBJECT
VERIFICATION PROCEDURE OF SUITABILITY TO THE STRATEGIC ENVIRONMENTAL ASSESSMENT OF THE IMPLEMENTATION PLAN RELATING TO THE AREA LOCATED IN VIA NOVATE, MILAN, NAMED PA8 VIA NOVATE, IN ACCORDANCE WITH DIRECTIVE 2001/42/EC AND LEGISLATIVE DECREE. N. 152 OF 3 APRIL 2006 AND SMI - MEASURE FOR SUBJECTION TO EVALUATION

whereas:
the competent Authority for the SEA expresses this Determination based on the results of the technical-investigative activities carried out in collaboration with the Proceeding Authority, having as their object the examination of the contents of the Plan, the Preliminary Report, the opinions, contributions and observations received during the consultation phase;

assessed that:
from the overall information contained in the documentation produced, from the feedback and contributions collected in the first and second sessions of the Verification Conference as well as on the basis of the results of the technical-investigative activities carried out, significant aspects emerged in terms of possible environmental effects of the PA which will have to be further explored, such as in particular:

• technical-legal framework of the public portion of the PA8 for the definition of the relative final destination and for the identification of the related environmental restoration works;
• identification of road solutions serving the new planned residential development that can minimize the effects on traffic flows with particular reference to the loads on the via Polveriera-Novate axis and on the intersection of said axis with via Comasina;
• search for greater integration and a more evident compaction with the existing urban fabric represented by the Comasina district and its surroundings, aimed in particular at better pursuing the objectives of the strategic project called RiconnettiMI in the PGT through a more linear and homogeneous connection between the public green areas of both Municipalities, existing or subject to compulsory transfer to the Municipality of Milan with this Plan;
• further verification of the cumulative effects determined by the new transformation - reset and reoriented as referred to in the previous points and on the basis of the economic resources that can actually be activated - in relation to the critical issues already existing in the reference context;

for all of the above

DETERMINE

1. to express - pursuant to art. 12 paragraph 4 of Legislative Decree 152/2006 and subsequent amendments, as well as in accordance with the provisions of the Regional Council Resolution of 13 March 2007 n. 8/351 and by the Regional Council Resolution of 27 December 2007 n. 8/6420, as amended by the Regional Council Resolution of 30 December 2009 n.8/10971 and by the Regional Council Resolution n. 9/761 of 10 November 2010, as well as by the Regional Council Resolution of 25 July 2012 n. 9/3836 - opinion of SUBJECTION to the Strategic Environmental Assessment procedure of the Implementation Plan relating to the area located in via Novate, Milan, called PA8 (Via Novate), for the reasons expressed in the introduction;
2. to incorporate the provisions and recommendations contained in Table 2, Chapter 3 of the Investigation Report (Annex 1) into the documents required by the SEA procedure and into the subsequent design phases;
3. that the Proceeding Authority communicates this opinion to the subjects competent in environmental matters, to the territorially interested bodies and to the additional interested parties, identified with Managerial Determination no. 19/2017 (Proceedings PG 468521/2017);
4. that the Proceeding Authority ensures that this provision and its attachments are made available by means of publication on the website of the Municipality of Milan and the Lombardy Region (SIVAS), as well as on the municipal noticeboard.
