Town Council. Simplified procedure and free land occupation for traders extended to 31 December

Milan, October 22 2020 – The City Council approved the extension until 31 December of the simplified procedure for traders relating to the request for occupation of public land and the exemption from payment of the Cosap tax. 

The resolution allows operators to add electrically radiated heating elements to the furnishings requested under concession. Without prejudice to more restrictive regulatory provisions, the provision allows the Administration to define through ordinances different opening and closing times of individual businesses or certain streets, neighborhoods, areas and areas most affected by population density, problems of public order or related to pollution acoustic and environmental.  
In order to avoid problems of safety and public order, a ban on the takeaway sale of drinks in glass or tin containers, including through vending machines, may be introduced in specific time slots, without prejudice to home delivery.   
  
The managers of the activities will have to contain the phenomena of degradation and disturbance to public peace and ensure the complete cleaning of the areas under concession and in the neighboring ones, taking care of the removal of the waste produced by their activity and of the patrons of the premises and equipping themselves with special containers for the rubbish collection.  
  
In addition to the application of the provisions regarding the containment of noise pollution and the related noise emission limits, external sound diffusion is prohibited. Finally, the sanctioning system to be applied in cases of disturbance to public peace and violation of the ban on gatherings also through the occupation of spaces exceeding the concession of the exercise or the legislative provisions regarding the prevention of the epidemiological spread of COVID-19 is clarified. Upon the first assessment of violation with the issuing of a report, the public land concession issued will be suspended for up to 3 days, upon the second assessment the suspension will be ordered for 5 days while upon the third assessment the authorization will be immediately forfeited.
