Fines and sanctions: appeal and rejection of the appeal

When is it possible to appeal against sanctions for violations of the Highway Code?
Appeal is permitted for the following sanctions:

  • statement of objection
  • infringement assessment report
  • payment order.

Remember
You can only lodge an appeal if you have not paid the fee.

If the Prefect does not accept the appeal for violations of the Highway Code, the effects are different depending on the reason for the rejection.

1. Orders Injunctions for dismissal of the appeal
The Prefect's Injunctions for violations of the traffic code are issued in the event of rejection of the appeal presented to the Prefect pursuant to articles. 203 and 204 of the Highway Code. The interested party can appeal to the Justice of the Peace within 30 days from receipt of the Injunction Order.

A pre-printed payment slip is attached to the Injunction Order to be paid within 30 days of notification.

2. Declarations of Inadmissibility of the appeal
If the appeal is not considered admissible, the Prefect does not issue an Injunction Order, but rather a Declaration of Inadmissibility. In this case the administrative process of the contested report is not interrupted. Even in the event of a Declaration of Inadmissibility being issued, the interested party can appeal to the Justice of the Peace within 30 days of receiving it.

A pre-printed payment slip is attached to the Declaration of Inadmissibility, to be paid within 30 days only if 60 days have already passed since notification of the contested report. In the event that the deadlines for paying the reduced amount of the report have not yet expired (60 days from its notification), it is necessary to use the pre-compiled payment slip, the one with the highest amount, attached to the original report.

In both cases, it is possible to appeal to the competent authority only if the fine has not been paid.

Failure by the Justice of the Peace to accept the appeal may lead to different effects on the sanctions for violations of the Highway Code.

1. Rejection with determination of the amount to be paid
In the event of sentences of partial or total rejection of the appeal of the Justice of the Peace for violations of the Highway Code (concerning reports and prefectural orders) the appellant of the sentence will be able to pay the amount determined by the Justice of the Peace by adopting the methods and using the channels described right away.

Payment is required within 30 days of notification. The sentence is considered to be notified after 6 months from the date of its publication, i.e. its filing with the registry.

2. Rejection without determination of the amount to be paid
In the event that the Justice of the Peace orders the rejection of the appeal without precisely determining the amount to be paid, the sum due amounts to half of the maximum established for the statutory administrative sanction, to which the costs of notification of the reports must be added.

3. Rejection referring to the Prefect's injunction orders
In case of rejection of the appeal without reference to the amount to be paid, the sum established by the Prefect before the appeal is confirmed.

For violations diverse from the Highway Code interested parties can appeal within thirty days from the date of the dispute or notification to the authority reported in the report.

To oppose a payment order from the Municipality of Milan you can appeal, within 30 days of notification of the injunction, by filing a summons with the competent judge at territorial level.

From 9 March 2020 to 15 April 2020, both the procedural deadlines for challenging the administration's injunctions and the possibility of submitting the related self-defense requests were suspended, under the conditions indicated in the documents. These provisions are contained in Mayoral Ordinance n.15 of 23 March 2020.

Use the pre-compiled Bulletin attached to the Order, or the one for the highest amount attached to the original report in the case of a Declaration of Inadmissibility and 60 days have already passed since notification of the original report for the reduced payment.
