CSP - Request for transformation of the surface right into full ownership

Reopening of the procedure for the transformation of the surface right into ownership of housing built in subsidized buildings (PEEP sectors), urban planning instruments governed by law 167/1962 and subsequent amendments. as well as by the art. 31 of law 448/1998 and subsequent amendments, as amended by art. 22 L. 108/2021 and art. 10 quinquies L. 51/2022.

The Municipality of Milan with Managerial Resolution no. 4804 of 14/06/2022 in implementation of the current legislation mentioned above, has approved the updated fees for the transformation into full ownership of PEEP accommodation.

They can submit the application:

• Owner(s) of the real estate unit or his delegate; the delegation must be accompanied by the owner's identification document;

The following documentation must be attached to the application:

  • copy of the notarial deed of purchase of the real estate unit;
  • copy of the condominium thousandth table, signed by the condominium administrator;
  • copy of the identity document and tax code of the owner(s).

All documents must be attached in pdf format.

The application, prepared using the form published below (Form 1-CSP Request) and accompanied by the necessary attachments, can be transmitted to the competent office via one of these methods:

- e-mail, to the email address: urb.valorizzazione@comune.milano.it

- Postal Service, at the address: Urban Regeneration Directorate – Implementation Planning 2 – Valorization and Evaluation Unit – via Sile, n. 8 – 20139 Milan.

The competent office, having examined the application, will send the applicant the proposal containing the amount of the fee to be paid. The applicant, if he intends to accept the proposal, must send the written communication to the office in charge on the appropriate form.

The fee resulting from the calculation can be paid in the following ways:

- in a single solution at least 20 days before the signing of the notarial deed, according to the indications of the competent office;

- in installments in two installments divided as follows:

  • n.1 – 50% of the total sum of the consideration to be paid at least 20 days before the signing of the notarial deed, according to the indications of the competent office;
  • n.2 – the remaining 50% of the total sum of the consideration to be paid after the signing of the deed and in any case within 12 months from the date of the same. This residual sum must be guaranteed by a bank or insurance guarantee policy, to be presented on the day of signing the deed, and which has the minimum solvency requirements required by current banking insurance legislation, for a period of 12 months.
