Access to administrative records and documents

Access to documents consists of the right to view administrative documents and obtain a copy of them.

All private entities, including those with public or widespread interests, who have a direct, concrete and current interest linked to a legally protected situation and connected to the document subject to the access request can request access to administrative documents and documents.

The request can be presented by the interested parties or by delegated persons: a legal representative-defender, an attorney or a guardian with a delegation.

The delegation, with a photocopy of the delegating party's identity document, must be attached to the request.

The methods of access to records and documents depend on the confidentiality of the content and the presence of other interested persons.

Informal access (verbal request)
If the type of document requested excludes the presence of other interested parties, the right of access can be exercised informally, i.e. after simple verbal request to the office that created or permanently owns the document.

The evaluation of the admission of access on an informal basis is the responsibility of the office manager.


Formal access (written request)
If a more in-depth assessment is necessary:

  • on the interest expressed by the applicant in accessing the documents
  • on the possible presence of other interested parties in the exercise of the right of access

It is not possible to request access to:

  • documents covered by state secrecy or by prohibition on disclosure established by law or government regulations
  • documents whose disclosure is prohibited by municipal regulations
  • documents relating to third party tax proceedings
  • documentation relating to the activity of the Municipality aimed at issuing general regulatory, planning and programming acts
  • documents relating to personnel selection procedures containing information of a psycho-aptitude nature relating to third parties
  • documents identified by resolution of the Municipality to which access has been expressly prohibited with a specific provision
  • documents subject to judicial seizure and held by the Municipality
  • documents requested for general categories, the knowledge of which is aimed at a generalized control of the Municipality's work
  • documents that concern sensitive data of natural persons and business groups, when they concern inviolable rights guaranteed by the Constitution, such as, by way of example: racial, religious affiliation, political opinions, health, religious beliefs, criminal records, correspondence, family status, economic and food relations. However, access to these documents is guaranteed when they are strictly indispensable for the care and defense of legal interests and, if data suitable for detecting the state of health and sexual life are present, within the limits imposed by the legislation on the protection of data confidentiality.

Other cases of exclusion from the right of access are regulated by art. 9 of Municipal regulation

Document format
It is possible to request administrative documents in the form of graphic, photocinematic, electromagnetic or any other type of representation only if these are:

  • internal or external to the Municipality of Milan only if in possession of the Public Administration
  • relating to a specific proceeding concerning an activity of public interest, regardless of their substantial public or private nature.


Cost
For the release of copies of the requested documentation, a fee equivalent to the cost of duplicating the documents will be paid, depending on the medium used for reproduction.

Payment for release at the counter is in cash. Those who receive the documentation via email or postal delivery have the option of paying by bank transfer.

The table relating to the applicable fees for the reproduction of administrative documents is attached to the request form.

Release
In the case of informal access or documents being published in the Notice Board, the release of a copy and examination is immediate. In this case, payment of any costs for document reproduction is required.

In the case of formal access the office must conclude the procedure within 30 days of receiving the request, with the exception of cases of suspension or deferral.


Shrinkage
Il collection of copies or viewing of documents must take place within 30 days of the communication of acceptance of the access request.

After this deadline, the proceeding is archived and the interested party will have to submit a new application.

It is possible to do appeal to the TAR – Lombardy Section:

  • against administrative decisions that deny the right of access
  • in case of implicit refusal due to expiry of the 30 day period without having received a response
  • in case of deferral of the access exercise.

The appeal can be presented personally and the party can appear in court without the aid of a lawyer.
