Urbanization works and services

This section contains the necessary documentation for the definition of the contents of the proposal for the implementation of urbanization works and service equipment by the private implementing entity in the context of urban planning and construction procedures. This documentation consists of:

  • Guidelines of direction to ensure adherence between project choices and the needs expressed by citizens, through information activities aimed at citizens and activation of participatory processes; Guidelines for the design, construction, testing and delivery of works and equipment, in accordance with the legislation on urban planning and construction and public contracts;
  • Operating procedures to simplify and coordinate the release of opinions as part of the preliminary investigation activity with identification of the necessary documentation to accompany the proposal; Operating procedures for the appointment of the test driver; Operating procedures for the request for anti-mafia documentation.

It should be noted that the review of the administrative acts which regulate the process of carrying out works assimilated to public works is currently underway (by way of example: urbanization works with deductions and services/equipment in place of the transfer of areas for the purposes of urban planning provision) in the context of urban planning and construction procedures (for example: implementation plans and affiliated building permits) in accordance with the new Public Contracts Code (Legislative Decree no. 36/2023).
Following the approval of these documents, the institutional portal will be updated, also with reference to the documentation to accompany the requests for these proceedings.

In order to guarantee adherence between design choices, quality of interventions and needs expressed by citizens in the context of urban planning and construction procedures which involve the creation of urbanization works and equipment for services, the Municipal Administration has approved the document "Guidelines for the experimentation of participatory paths within the procedures of the Central Territorial Development Directorate and adoption of the participation charter of the National Institute of Urban Planning". The document defines the methods for guaranteeing adequate information activity to citizens and/or interested parties, as well as for the launch of participatory processes (consultation on needs or consultation on the initial project proposal) before or in parallel with the carrying out of the urban planning procedure -building (Resolution of the municipal council n. 1086 of 27.5.2016)

Resolution no. 1086/2016 of 27.5.2016 "Approval of the guidelines for the experimentation of participatory paths within the procedures of the Central Territorial Development Directorate and adoption of the participation charter of the National Institute of Urban Planning"

With the aim of providing criteria and guidelines for the implementation of urbanization works and equipment for services by the private implementing entity, the Municipal Administration has approved the document "Guidelines for the implementation of urbanization works and public services and of public or general interest in the context of urban planning and construction procedures”. The document defines the methods for carrying out the planning, assignment and implementation of the works, testing and taking charge of the works in accordance with the legislation on urban planning and construction and public contracts (Resolution of the Municipal Council n. 1117 of 10.6.2013)

It should be noted that, in relation to a procedure opened by the European Commission with the Italian Authorities, referring to the contested incompatibility of various national regulations with the Community Directives for the methods of calculating the estimated value of contracts, the Municipal Administration has issued transitional operational indications relating to the verification of exceeding the threshold of community relevance (Managerial Resolution no. 40 of the Director of the Central Territorial Development Directorate dated 28.9.2016).

Following the regulatory clarifications that will be provided by the Authorities, the Municipal Administration will proceed with the modification of the Guidelines approved in 2013.

 

For the urban-building interventions that cause interference with mobility, the Municipal Administration has approved the methods for coordinating road traffic opinions, identifying the guidelines and functioning of the body responsible for verification (Intersectoral Committee for Transport and Mobility), the procedure and the documentation to be produced (Managerial Resolutions n. 13/2014 of the Deputy General Directors of the Territory and Citizen Services Areas dated 19.6.2014).

In the direction of reducing and/or replacing paper documentation with the digital format, an update of the documentation to be prepared was subsequently approved (Managerial Resolution no. 13/2015 of the Directors of the Mobility Planning and Programming Sector and of the Technical Infrastructure and Street Furnishings Sector dated 18.3.2015).

Furthermore for the definition of the contents of the various types of public works and services or of public interest, the Municipal Administration has approved the necessary documentation for each phase of the urban-building procedure in relation to the design levels (Managerial Resolution no. 1/2016 of the Deputy Directors General of the Territory, Citizen Services and Innovation, Economic and Social Development Areas).

With reference to the criteria identified by the "Guidelines for the implementation of urbanization works and public services and of public or general interest in the context of urban planning and construction procedures” the Municipal Administration has approved the procedure for the appointment of the tester, to also be applied to works and service equipment worth less than one million euros (Managerial Resolutions no. 60/2018 dated 9.5.2018 and no. 12317 dated 29.12.2021 of the Director of the Urban Planning Department).
