Enhancement of public spaces art.80 c. 3 of the Building Regulations

PROCEDURE FOR TAKING CHARGE OF THE APPLICATION FOR AUTHORIZATION TO TAMPER WITH PUBLIC LAND BY THIRD PARTIES PURSUANT TO ART. 80, PARAGRAPH 3 OF THE BUILDING REGULATIONS

  • CONDUCTION OF THE INQUIRY PHASE:

Having received the application and verified its completeness, the Advertising and Land Occupation Area, after possibly requesting additional documentation, convenes a Services Conference. 
The Services Conference will evaluate the project by collecting the relevant opinions and requesting, if necessary, a possible adaptation of the project. 
At the end of the investigation, based on the results of the Services Conference, the Advertising and Land Occupation Area will communicate to the proponent the approval and authorization of the project or the rejection of the application and, in the first case, will request the necessary documentation to ensure can start the works, including the guarantee.
Once all the documentation has been acquired, the authorized project for the start of the works will be sent to the Mobility Directorate / Mobility Infrastructure Technical Area.

  • REALIZATION PHASE 

The Mobility Directorate / Mobility Infrastructure Technical Area will take care of the technical activities for the coordination and supervision of the implementation phase until the end of the works and the acquisition of the Certificate of Regular Execution. Once the intervention is completed, the technical documentation will be sent to the Advertising and Land Occupation Area for the conclusion of the procedure

  • CONCLUSIVE PHASE 

The Advertising and Land Employment Area will adopt the final measure of the procedure and will partially release the guarantee.

After 1 year from the signing of the Certificate of Regular Execution, following verification by the offices responsible for checking the correct execution of the works, the remaining portion of the guarantee will be released/returned

  • TIMELINE FOR CLOSING THE APPLICATION TAKING CHARGE PHASE:

The deadline expected for the conclusion of the project authorization procedure is a maximum of 80 days from the filing of the application, unless different deadlines are due to the adaptation of the project or the acquisition of opinions external to the Area.
The implementation phase will be managed by the Mobility Directorate / Mobility Infrastructure Technical Area.
